Rape claim (Walking into the wrong room lands man a rape charge)

A MAN who claims he mistakenly had sex with "the wrong woman" after entering a dark bedroom at the home of a Sydney magazine editor was yesterday committed to stand trial for rape.

Paul John Chappell, 31, was invited back to the editor's Bondi flat after they met during a night out. The pair went to bed and Chappell later got up to use the bathroom. But Chappell claims he mistakenly returned to the wrong bedroom, where the editor's 23-year-old flatmate was asleep.

He got into bed with the flatmate and initiated sex, allegedly believing she was the other woman. The flatmate participated because she thought it was her own boyfriend who had come to bed after falling asleep in the loungeroom. When she turned on the light, the "hysterical" woman saw Chappell in her bed and realised her boyfriend was still asleep on the couch.

"He thought he was having sex with the person he went home with. "The (alleged victim) says she believed she was having sex with her boyfriend. She made a mistake as to who she was having sex with and so did the defendant."

that wasn't a rape, she consented, just because she thought he was a different guy than she thought doesn't mean he forced himself on her. whats next? will it be rape if she had sex with a guy who lied about being an airline pilot?

This is absurd! You mean to tell me that neither one could tell that they were not having sex with their normal "sex partner"? Riiiiiiiiight.

Give the poor girl a break. She had only been going with the guy for three days.

From the story, it seems like the male had only met the woman that took him home and they never had sex.

One of my "favorite" NY Times front page articles was a discussion of "rapes" that are not (yet) criminal. I kid you not, they told the horrifying stories of women in long term sexual relationships with men, who had sex on nights when they didn't really feel like it because they "knew" their partner would not take no for an answer.

Perhaps the best one was the woman who didn't really feel like sex, because she had dental work done that day. But after a night out drinking with her lover, when they got home she "knew" from the look in his eyes that he would not accept rejection. So she had sex with him anyway. The NY Times was trying to make such situations illegal.

I'm seeing this as rape. The way I read her comments is she was asleep when the sex began and she woke up during the sex. After heavy drinking it takes awhile to fully wake up. If she consented and wanted to participate do you all think she'd freak and run out and tell her friend and boyfriend?

He walks in to dark room.
She in the dark room consents to sex with man who entered in dark room.
During the sex act they consented.

After the act complete, OOPS when the lights go on.

NOBODY NOTICED?!

This seems like a caviat emptor, pig in a poke, glass house kind of situation.

IOW if you jump the person you feel in the dark you have no right to complain about what you see when the lights come on.

Yep, it was slipping into the wrong woman! To borrow your phrase, to be honest she supposedly made a mistake too. You would think she would ask who was starting up sex with her or that she could tell the difference between her boyfriend and this guy!

Doesn't matter why she participated, but she gave consent. If he didn't leave after she said for him to leave, THEN it's rape. Before that it was just a stupid woman.
