Flip-Flop In Duke Rape Scandal (Source: Timeline Supports Duke Players)

CBS News correspondent Trish Regan reports that defense sources say Finnerty was eating at a Mexican restaurant when the alleged rape is said to have occurred. And they say Seligmann may not have been in the house during most of the time the alleged rape was carried out.

According to a neighbor's testimony, the stripper arrived at the house around 11:50 p.m., although the prosecution may argue she arrived earlier.

The defense says it has time-stamped photos of the stripper. The first was taken at midnight, followed by a series of pictures over the next four minutes that show her and Roberts.

There is a time gap in the photos of the alleged victim between 12:03:57 and 12:30:12, when she's seen at the back entrance of the house and appears to be leaving. A neighbor said he believes he saw her in the front yard sometime between 12:20 and 12:30.

Based on the time-stamps, there is a 16- to 26-minute window in which she could have been assaulted. But, during most of that time, Seligmann may not have been in the house.

Sources for the defense tell CBS News that cell phone records show Seligmann made calls at 12:07, 12:09 and 12:11. At 12:14, he called a cab to pick him up. Driver Moez Mostafar says he got that call and showed CBS News his dispatch records to prove it. He says he picked up Seligmann at 12:19.

"He looked normal, nothing looked unusual to me," Mostafar said. "He asked me to go to Wachovia Bank where he can get some money.

A question that keeps rolling around in my head....

I wonder if there are more pictures from other cameras?

There could be other pictures between 12:00 and 12:30, that the defense is holding for trial. I bet they released these pictures as a warning shot to the prosecutor.

Duke rape defense will challenge IDs, source says - CNN

DURHAM, North Carolina (CNN) -- Defense attorneys for two Duke University lacrosse players charged with rape are questioning the process by which the accuser identified her alleged attackers, a source close to the defense told CNN Friday.

Under the procedure, the accuser was shown images of the team's 46 white players and told they were people police suspected were at the party, the source said.

The defense will likely file a motion to suppress the identification because no pictures of non-team members were included in the presentation, the source said.

Legal experts told CNN that authorities would not necessarily be required to show pictures of unrelated people with pictures of the lacrosse players.

District Attorney Mike Nifong did not return a call seeking comment on the identification procedure.

My view from a far is that what kicked this case into national attention was not the racial angle, but the feminazis. It that respect Duke, not the players, deserve what they get.

Duke and institutions of higher education in general are authority, are the establishment etc. Yet they hire these feminazis who do not have the good sense not to attack the very institution they work for.

Well if Duke is down 1,000 students next year, that is 1,000 times $40,000 in tuition or $40,000,000. There is some serious money being gambled with here. I wonder if the DADA refusing to talk to anyone but NC papers and talking only about his handling of the case is because someone has gotten to him and point out the amount of money he might be causing not to come to Durham in the next decade.

I think the defense release of the pictures was targeted at the accuser, in hopes that she would recant before making the colossal mistake of falsely IDing particular players. The IDs were made on April 4, which was before the DNA results and the photos release, but I don't think the defense team knew she had made those IDs until just before the indictments came down.

So, the accuser was told the "pictures represented people the police thought were at the party". That is where they went wrong imo. They should have told her the pictures represented people who may or may not have been at the party. If she thought she could be caught IDing a police decoy or a mugshot of a burglar in jail at the time of the party, she may have been leery of IDing anyone.

I think by April 4, Nifong had been given a heads up by the SBI lab that DNA matches weren't found, and Nifong then pressured the AV to come up with IDs. Without those IDs Nifong couldn't have gone to NCCU several days later with his self-serving "As long as I'm here, the case isn't going away."

To say nothing of the fact that the DA actually broke the law by not having pics of people who could not have possibly done the deed, who weren't in town on that day/night, etc.

This law was actually brought about in the 60s when the police would have an alleged, black, accused, suspect in a "line-up" with 4 whites, for example. In those days the black suspect, whether he was the actual person who had committed the crime, would get fingered in the line-up.

Or if the suspect was described as tall and slim then the suspect was put in a line-up with four, short, fat people.

I think you get the idea but the original intent against those kinds of procedures was to make sure that blacks weren't fingered just for being black.

She would have picked out a partygoer in any case. This isn't like a rape accusation against a stranger. She was at the party and she could have recognized at least three LAX players in any lineup, although she might have made a mistake.

The fact that she made the ID on April 4 is interesting. By that time, were the websites up that had the information on the players? Is it possible that her third ID was one of the players that was out of town? Is that why Nifong won't release it?

The accuser made an ID on April 4, but I don't know if she ID'd both players then. Nifong went to the forum at NCCU on April 11, and according to this link he "hinted" that she had made one ID: http://www.herald-sun.com/durham/4-723445.html

Meanwhile on April 5 in the New York Times and on April 6 in the News and Observer, stories about Finnerty's previous "assault" case last fall appeared. I wonder if the accuser learned of Finnerty's trouble, and specifically looked for his picture when the next photo line-up took place?

Of course, choosing the richest members of the team work for both the DA (easy to demonize in Durham) and for the accuser (potential civil lawsuit). In any case, we shouldn't be speculating about this. The defense should know all of this information based on disclosure.

And certainly, Finnerty's previous case makes him look incredibly unsympathetic.
One of those cases of "well, he might not have done it, but he deserves what he gets."

Well if Duke is down 1,000 students next year,

Never will happen. And, if it does, my daughter would be estatic because it would increase her chances of getting accepted. I'm a Duke grad (MBA). I have no problem with her going to Duke if she's accepted. 'Course we're looking at UNC-Wilmington and Campbell... Duke doesn't have a Pharmacy program.

Duke is rated "highly selective" and has a long waiting list. I do think they may get fewer National Merit type students who look good in the stats all universities point to as indicative of their quality.

They are very likely to get fewer NY/NJ kids with money who pay their own way. And the academic standards will have to be decreased, no doubt.
