Breaking overnight from Chris Cummo at ABC GMA:

Case against at least one Duke defemdant unraveling fast.

Defendant Seiligman went to bank ATM while rape supposedly happening.

12:02 Time stamped photos show girl arriving. Girl leaves, comes back, call friends on cell phone does other things. 12:19 Seiligman calls cab dispatcher 12:24 Seiligman takes cab to bank miles away, uses ATM card (photos show it is him.) 12:42 after walking back to dorm, Seiligman uses security card to enter dorm. Does not leave.

Also, Seiligman was never interviewed by cops. DA seeking reelection simply took "Dancers" word that he raped her.

I was watching Greta's show last night, and was amazed at the emotion with which Ted Williams spoke about these suspects and this case. Through my eyes, it seemed way out of proportion to the discussion of emerging facts about Seligmann's alibi. He could barely control his outrage. It comes from a place I can't understand.

All 12 of the taxicab companies serving Durham contacted by The Herald-Sun on Tuesday said they did not dispatch a driver to 610 N. Buchanan Blvd. on the night of the alleged incident.

This puts a hole in the airtight alibi.

That tells you a lot more about the Herald-Sun than it does about the alibi. The implication in the story is that there are 12 taxicab companies and that they checked all of them for the story. Then they try to go even further by saying the one that seems likely to them to carry duke students didn't pick them up.

By not telling readers that there are 30 or so companies in town and that there are far more that were NOT checked than were - they are either lying or incompetent.

This case should be a lesson to all the naive people who think you can trust cops and DAs to act fairly or justly.

Never talk to a cop about a crime if you think there is even a remote possibility they are trying to nail you for something you didn't do. If you think they aren't out to get you, you are wrong.

Never step outside your residence to talk to them or allow them inside. Once you do, they can screw you over in a heartbeat. Never go down to the precinct or station to talk to them. If you are going to talk to them, do it in a public place with a witness and a recording device. If they object, I guess they really aren't all that interested in talking to you.

Well right, but when Nifong and the press accused the whole team and the lynch mob atmosphere set in, the players got counsel and refused to cooperate. And based on what I've read this will be the accused's salvation because Nifong had to shoot in the dark (i.e. take the AV's ID as gospel, not knowing who had an alibi). It looks like her 100% ID was just a bad guess.
I'm betting he doubles down on this one and arrests another player to perp walk him too for maximum press pre primary--and maybe this one will not have an alibi.
We are all taught to cooperate with the Police, had these kids done so it appears Nifong would have fit the ID to the non-alibi's. A really bad lesson in Civics.

The last time Duke lost a president in similar circumstances was when Douglas Knight was unable to handle the campus unrest in the 60's. He was replaced by Terry Sanford in 1969. Ironically, like Brodhead, Knight was a Yalie academic.

Before Duke, Terry Sanford had been an FBI investigator, served in the Airborne in WWII and been Gov. of NC. After Duke he was senator from NC. "Uncle Terry" as the students fondly called him would have known how to handle this. Where is a man today like that in North Carolina public life? Maybe Jim Black or John Edwards? (Gag, gag, choke, choke, barf, barf)

I think it's extraordinarily unlikely that these guys tampered with the photos either before or after they were taken. These are college kids at a girlie party, not master criminals.

I bet that Nifong offers "expert testimony" at the trial that the investigation of the validity of timestamps is "inconclusive".

He did the same thing with the DNA tests that came back negative.
