*Vanity-Greta said the Vandersloots served with lawsuit-on show tonight
FNC | 2-16-06

Posted on 02/16/2006 2:23:37 PM PST by STARWISE

Greta came on with blockbuster development. Twitty's attorney, John Q. Kelly, apparently had the moves of the Vandersloots under extreme scrutiny. The Vandersloot parents had flown to NYC for an interview with ABC .. Joran was en route from the Netherlands to NYC to meet with them.

Kelly had a former law enforcement official seated 3 seats in front of Joran on the plane, and when they were on American soil and were about to deplane, he served papers on Joran for 3 counts. Simultaneously, the Vandersloot parents were served in NYC ... the father charged with 1 count.

Greta says the intrigue is worth of James Bond, and this unusual service is amazing .. she's not spoken with Beth Twitty. Will have more tonight on her show.

Didn't see any evidence this was posted .. was announced about 40 mins. ago.

He's the attorney who got the civil case settlement from OJ for the Browns for Nicole's slaughter.

Seems to me there was a guy named Petrocelli who had more than a little to do with that civil case.

I'm going to assume he served the papers AFTER he got off the aircraft. As a rule of thumb, it's not wise to serve someone when you have no escape route.

Referring to van der Sloot as "the predator," the lawsuit says that on at least three occasions young Aruban women have complained they were the victims of "date rape" by him and his accomplices.

(snip)

The lawsuit says the father, Paulus van der Sloot, was an enabler of his son's "violent and anti-social lifestyle." Court papers say that on the night of May 29, 2005, he went with his underage son to a casino to play poker. It was at that casino that the younger van der Sloot met Holloway, the lawsuit says.

The court papers present a partly speculative version of what happened after the young people left the casino and went to a bar called Carlos 'n' Charlies in the early hours of May 30, 2005.

At about 1:30 a.m., court papers say, an intoxicated Holloway left with van der Sloot and the Kalpoe brothers. Several of Holloway's friends saw her in the car with the youths and asked her to get out, court papers say, but she did not.

"The next hours of Natalee's young life were marked by torment, terror and debasement," court papers say, describing an imagined sexual assault. "Natalee has not been seen or heard from since entering Deepak's car with Joran."

Balber would not say where he believes the van der Sloots are staying in New York. He said he believed that as of Thursday, when they were served, they had not retained a lawyer. Balber explained that if a defendant is served with a summons for a lawsuit in the state and neither party lives in the county where the summons is served, then the plaintiff gets to decide the county in which the lawsuit is filed.

~~~~~~~~~~~~~~~~~~~~~~~~~
No matter what happens now, Beth is on her on turf, making her moves with a very competent legal and investigative team behind her, in the USA. If anything can be done, they'll do it. I pray their efforts are fruitful .. and the name VanderSloot ends up defining scurrilous morals to the whole world, hounding those horrible people forever .. wherever they run.
Well, at least they'll keep them from parading around pronouncing their innocence without fear of contradiction. If they prevail, they may be able to grab any profits from transactions made in the U.S. And, there's always the slim possibility that they'll push the other side into making some sort of inculpatory move or statement that'll interest the Aruba authorities. I'd say the first move(anti P.R.)is probably where the suit'll be helpful. The rest of it's primarily just good theater.
This is really quite clever isn't it penowa? We all know that these cowards will never allow themselves to be deposed. Nor will they ever show up to face a court ordered demand. However, what they CANNOT stop is a DEFAULT JUDGEMENT!! That screws their little money making schemes.
This is a Civil Law Suit, not criminal, so NY cannot hold these people.
My feeling is John Q Kelly was able to have Joran and parents lured away from the judicial safety of Aruba and the Netherlands to NY to appear on some network show to tell his side of the story . When they hit the soil of NY State they were slapped with a Civil Action for rape, empowerment, unlawful detention etc.
In non-legal lingo, can someone please explain to me whether there are any real teeth attached to this? What impact would a civil suit in an American state to a foreign national for a crime that has a cold scent, and that occured in a foreign nation have? Add to this that any evidence (if it can even be called that since most of it seems to be along the lines of 'I know they did it but I cannot prove it') was either shoddily collected or non-existent. I know that civil cases only require a preponderance of evidence, and thus are far less stringent than criminal cases, but this still seems rather nebulous at best.
I'm glad that finally some real action seems to be implemented, but is their any real significance to this act or is it mostly symbolic? Thanks.
This has no teeth...this is just a media spectacle. Oh, the internet junkies of this story will love it and talk about how great it is, but really, what will happen?
First, it is a civil suit. NOONE can be compelled to testify in a civil suit. Worst that happens, you get a default judgment. In this case, however, the Holloways won't do that.
Two, what the Holloways will do is use this as their forum. They will likely put on a case without the defendants present, with no defense testimony, and get a judgment. I doubt they are after the money, but are just trying to use the court as their forum.
Thus, nothing will come out of this that we don't already know, b/c the VdS will never step into the courtroom or testify "under oath".
I won't post on these Holloway threads any more, as there is a wacko FReeper element that follows this story...just listen to Greta's breathless reporting and be entertained...because at this point, that is all that Greta is doing.
This is a bit beside the point, but anyone know what legal fees are involved? The "meter" has been running for a very long time now.
One thing is for sure, if they flee back to Aruba and let the suit go default, it will make Joran look even more guilty than he already does, after all, if he didn't do anything why not answer some questions under oath?
I am a law student, but I am not sure about these jurisdictional issues. That will be the first thing that the Van der losers will raise. It would be different if the crime was committed here, there has to be some type of minimal contacts with NY... I am wondering if (supposedly)the fact that the Van Der Losers are working on a book deal that they stand to profit from and that book deal allegedly is taking place in NY, and is about Natalee, if that would help in any way with jurisdictional issues. This one is way above my 1 year in law school...but John Q. Kelly seems to think the jurisdiction problem is not a problem.
I hope this leads somewhere for the family's sake.
>>>Gee, I guess this is the end of the big blockbuster U.S. book and movie that PvdS was arranging for the Pimpster. He had even signed a contract for publication so I guess if they default on the H/T's law suit the Pimple won't be able to finish the book and he spent all that time writing the first 50 pp already. Isn't that a pity?<<<
If this civil suit does nothing else but prevent that swine Joran from publishing a book about Natalee's disappearance, it is well worth it.
Kudos to John Q Kelly.
Joran just can't seem to make up his mind. Which story are we supposed to believe.
There's statement given to Beth that states he said he did have sex with her. In the NOVA interview he said he didn't like her much and she was not someone he would want to "have a relation with". But, in the ABC interview he says they planned to have sex but didn't because he didn't have condom so they just 'cuddled' on the beach.
Sheesh...so which is it? It can't be all of those.
No, but if you have sex with someone you just met and that person is in semi unconscious state that would make it rape which is in fact against the law.
If it is violative of the law in Aruba, and those are the facts, then I'm sure that Joran will be charged with rape under Aruban law.
