My opinion:
1. Harmless fun on behalf of the teacher.

That was way over the line. Had it been a regular class and simply a joke, it might have been okay (although still excessive, IMHO). But the kid showed up for a midterm, and this stuff doesn't belong there.
As for the kid striking back - which a number of folks here have suggested - who do you think would be off the football team, probably out of school, and possibly even looking at a felony charge? Not Teach.

I remember a time when class punishments for various infractions were: drawing a circle on the chalkboard, standing in front of it and putting your nose in it for the duration of the class; sitting in the corner wearing a tall cone-shaped "dunce" hat; writing "I will do/not do something" a hundred or more times on the board; standing in the corner facing the corner for the duration of the class. And so forth. We never felt we should sue because we were humiliated. The humiliation was the punishment. We took it like the little boys we were.

I feel terrible for this kid. He'll have to wait until 2009, but I'm gonna invite him and his jersey to the Bronco's at Eagles game as my personal guest. I won't be standing too close to him, but I'm sure he'll have a nostalgic time.
