I have in the past proudly called myself a "bushbot" on this forum.
Initially I was disappointed, but supportive of this nomination.
However, as time has gone by, enough has leaked out about Ms. Miers to make me seriously doubt that we can afford to take a chance on a woman who not only has no background in Constitutional Law whatsoever, but - and this is the key - has, according to reliable reports about her stint on the Dallas City Council, shown herself to be very vulnerable to the kind of "go along to get along" attitude that doomed Bush 41's presidency.
And once she's up there, there ain't no way out for us if this likely scenario comes to pass.
THAT is why we need a "name conservative" who can be trusted not to jettison his/her judicial philosophy once on the bench.
No more O'Connors, Kennedys or (God forbid!) Souters!
Here is what I now believe will happen, based on my 40 some years surveying the political scene:
I believe that conservative opposition to this nomination - stunning in its sheer breadth - has reached "critical mass".
In order to avoid the continuation of this slow-motion car crash - and further embarassment to herself and the President - Ms. Miers will wind up withdrawing her nomination. (Besides, as soon as the president had to come out and defend her in public as he did a few days ago, her fate was SEALED. This is the KISS OF DEATH to a nominee for any position. You can verify it if you have the time to search the archives from Reagan to Bush 43. Its a dance with only one outcome now.)
As far as the "we-can't-get-anyone-else-confirmed" defeatism discussed in a very good thread by pukin dog recently, I reject it out of hand. Nominate the right man/woman, and then "GO TO THE MAT".
Period.
If they are rejected, then nominate another - its the 'Rats that will suffer for their obstructionism at the polls, not conservatives - a lesson one would hope we all learned from the "Government shut-down" disaster of 1995.
Ms. Miers was never within the top 10,000 best qualified nominees, and additionally enough questions have been raised to make the hair on your neck stand up - we've been here before. No more "ciphers" a la Souter.
I guess when Judge Bork came out unequivocally against this nomination it clinched it for me.
I admire Judge Bork greatly (I had a chance to discuss Constitutional theory with both him and future Justice Scalia at the 1985 Federalist Society D.C. conference.)
You know that, given his experience, Judge Bork would not have come out against this nomination the way that he did unless he was 100% convinced that this nomination has the potential to truly be a FUTURE disaster should Ms. Miers be confirmed based on the Administration's nudge-nudge-wink-wink say so.
I voted for GWB 4 times, and have only the highest admiration for him and his leadership in the current war - so much so that I have overlooked much of his domestic policy;
But if I could say anything to him now, it would simply be:
"Mr. President, this camel is simply too large for us to swallow."
I'm not one to post vanities myself, Al, but I'm sure glad you did - I echo your thoughts exactly. Thanks for the post!
Bravo! Bravo! Maybe Free Republic is not a lost cause after all.
That's nothing, there are Democrats who voted for JFKerry 20 times, in one election.
Yet you demand more of the same...whatever.
Correct, if we wanted someone to rollover, we would have elected Madonna.
I pray that you are wrong.
Feel free to include any judges Harriet.M recommended for nomination.
Martha Hill Jamison, 164th District Court of Houston. Appointed by Governor George W. Bush.
Alberto Gonzalez, Texas Supreme Court. Appointed by Governor George W. Bush.
Allyson Duncan, U.S. Appellate Court. Appointed by President George W. Bush.
Would you like to get started on all the "reliable conservatives" Bush has appointed to cabinet positions too? Paul O'Neil comes to mind.
The fact is that this administration has a stellar record on appointing constitutional originalists, with Harriet.M in the middle of that selection process.
You have no evidence that suggests she her judicial philosophy is not far from Thomas.
On the other hand I have heard her speak on such matters, she is no Souter.
;^>
And btw - welcome to the FR.
Amazing the energy our side can muster to torpedo a Republican SCOTUS nominee. If only we had generated one-hundredth the passion and political heat when Clinton nominated Breyer or Ginsburg.
Thank you, very eloquently said.
a. There was no Internet; and
b. The GOP Senators were AWOL...
My, my. I guess Peggy Noonan and Laura Ingraham were reading this vanity because - all of a sudden, EVERYONE seems to be saying that Ms. Miers will/should withdraw her name from consideration.
And no one is even paying me to write this stuff!!!!!!!!!
*LOL* ;-)
