"Idol" Finalist Dodged Cocaine, Pot Raps (Bo Bice)

APRIL 28--One of the five remaining "American Idol" finalists was once arrested for felony cocaine possession, but had the charge--and a separate marijuana count--dismissed last year after completing a so-called "diversion program," The Smoking Gun has learned. Harold "Bo" Bice, 29, was busted in June 2001 by Huntsville, Alabama cops and hit with the drug count, a Class C felony, according to the below warrant. He was arrested again in July 2003 near Birmingham and charged with marijuana possession, public intoxication, and possession of drug paraphernalia, according to court records. He pleaded guilty to the latter two misdemeanors in December 2004. The pot charge was dismissed after Bice's successful completion of the same diversion program that covered his prior cocaine bust. In that 2001 case, a District Court preliminary hearing was set for August 29, but when a Huntsville Police Department investigator did not show, Judge Susan Moquin dismissed the Bice case, according to a court docket. But with prosecutors prepared to refile the felony count, Bice later opted to enter a drug diversion program overseen by the district attorney's office, according to Heather Douglas, spokesperson for the Madison County D.A.. Bice formally entered the diversion program in 2003 following his pot arrest, and the two separate drug possession charges were effectively merged and covered by Bice's diversion program, according to a TSG source familiar with the cases (the cocaine charge was bounced on April 28, 2004, and the pot rap was dismissed five months ago). Bice was arrested on the cocaine charge after scoring about 1/2 a gram of the drug from an acquaintance at Huntsville's Silver Dollar strip club, according to a source. If convicted of the felony coke charge, Bice would have faced a maximum of 10 years in jail, though a probationary term would have been more likely. While details of what Bice had to do in the diversion program are confidential, enrollees usually must submit to urine tests, undergo drug counseling, and attend awareness classes. Bice, who worked at the time in a Huntsville bar, is a long-haired rocker whose gritty appearance and performances have stood out from "American Idol"'s usual pop pablum. On Fox Television's "Idol" web site, Bice reports that his "most embarrassing moment" was when he once "fell off stage during a show."

If you would read the article, you'd see that the offenses took place in July, 2003, but didn't go to court until December, 2004.

Yes, and the first offense took place in 2001, which means that his drug 'diversion' classes didn't help much. I think the article said that he had to take it again.

Then in the post you seem to take issue with, I quoted what the smoking gun says about when he pled guilty. (December 2004) There is nothing inconsistent in those two posts. Both are correct.

Are you one of the ones who is excusing Bo's drug use?

Bo's crimes were more serious than the cell phone toss of Scott's.

Perhaps I am missing your point. My point is that this is a much more recent issue than Scott's and is a much more serious crime. People have been tearing Scott to pieces, but most people here are excusing Bo and his drug arrests.

That makes me sick. I don't know where you stand on this, so if this doesn't apply to you that's good and you are a better person than some here. For those who are excusing Bo, they should be ashamed of the double standard.

Lesser offense?? You really think beating up a woman is a lesser offense than smokin' a few "j"s. Sorry, but I don't agree.

I know some on these Idol threads seem to find blame with the woman in this case. I have no idea why. There's NOTHING in any of the reports to indicate that she was to share in any of the blame. It was at HER house for God's sake!

Bo was in a "rock band." Face it, a lot of guys in rock bands do drugs. Does that make it right? No, but it happens. Bo's attitude seems repentive and he's turned his life around. I see no indication that Scotty the Potty has done the same.

He "lumbers" about like a wanna-be-ghetto-boy who has about as much talent as a guy in a bar on Karaoke night.

He "sneers" at the judges when they DARE to point out the fact that he was "off key" during most of the song.

Scott does not deserve to be in the Top 5. He should have been thrown out weeks ago. Perhaps that is slightly clouding my judgement, but I don't see it that way.

I can't believe you would say that an "assault" is no big deal!

Any guy (especially one as large as Slingblade) who "assaults" a woman is dirt. Case closed!

Two things factually wrong with that--

1) Slingblade didn't "beat up" the woman. He threw a phone at her. If it were more serious than that, the woman would've called the cops that night instead of waiting until the next day.

2) Bo was scoring coke too, which is a much heavier charge than just smoking pot.

I welcome your opinions, but at least get the facts right.

His father was on one of the local news stations (I live in Huntsville) claiming that he was set up by his junkie Aunt. Supposedly the Aunt made a deal with the police to lower her charges if she would turn in other people. The Dad claims that the cocaine was slipped into Bo's jacket that was on a chair while he was on stage performing.

Bo has alot of talent and his personality is so humble and pleasant when he is asked questions or being candid.

I still like him, and will vote for him.

Everyone condemning him for a past drug offense - which is in his past - do they also condemn George Bush for his past alcohol problem which he admitted to - or were they able to appreciate people who overcome their problems?

People who are so unforgiving better hope everyone in their life remains perfect.

couple of things....

I never really dwelled on the Scott problems in his past, I just don't like his singing.

Plus,I figure if it was really bad they would've taken him off the show.

I think the timing is very odd about this "BO" news....smoking gun usualy is on top of these things....

I'm not into "conspiracies" but is someone else the favorite (carrie? scott?) and they want BO out of there?

things to ponder, I'm sure this will make the ratings go through the roof.
