Could Judge Greer Order Teresa Schiavo to be Shot?
vanity | March 27, 2005 | Jim Noble

Posted on 03/27/2005 3:48:07 PM PST by Jim Noble

It's been pointed out on another thread that the judge in Florida has ordered nothing by mouth for Terri Schiavo.

First: Is this true?

Second: If so, what is the authority for such an order? Removal of a feeding tube, I can understand, under certain circumstances. This may even be legal in Florida.

But nothing by mouth? This is an order to kill her.

Where does this power come from? Could he order her shot? Could he order a lethal injection?

If not, is it possible that his order is facially illegal?

Here's the judges ruling:
Order
This cause came before the Court for hearing on March 7, 2005 on Respondents’ Emergency Expedited Motion for Permission to Provide Theresa Schiavo with Food and Water by Natural Means after the assisted nutrition and hydration are discontinued. The Court heard the argument of Daniel Gibbs, for the Respondents and of George Felos, for the Petitioner.

Having also reviewed portions of declarations or affidavits of several doctors, which were submitted to the Court by Respondents, it has become clear that the motion is part and parcel of the Respondents’ FLa. R. Civ. P Rule 1.540(b)(5) motion on medical evaluations. The same declarations are being used for both motions and the motion appears to be an alternative pleading to the 1.540(b)(5) motion. Both are asking for an experimental procedure. The Court reasons that if the 1.540(b)(5) motion is granted, there is no need for this motion. If the 1.540(b)(5) motion is denied, the Court should not do indirectly what is has not done directly.

It is therefore
Ordered and adjudged that the Respondents’ Emergency Expedited Motion for Permission to Provide Theresa Schiavo with Food and Water by Natural Means is DENIED.

No judge can order people to be killed.

You can deny it, but I see it fairly frequently. I don't know how to explain why we have different realities.

A warped and twisted rational....and that's where he is most vulnerable.

"she has chosen herself to terminate her own life support"

Is this on tape somewhere? Is it written down somewhere. And you didn't answer the question.

Removal of the feeding and hydration tube is allowable under Florida law.

Yes, yes, I know.

My question was, can the same court order that she not be offered food or water? The court appears to have done so, I contend that's the same order as "shoot her".

Do you disagree?

Too bad Greer didn't have the guts to shoot her on TV. He is a coward. Any supporter of dehydrating Teri unto death who wouldn't pull the trigger is a coward and a hypocrite.

What he is saying is ie. somebody is prohibited from ever getting an aspirin....therefor they must also be prohibited from getting a Tylenol because aspirin was prohibited.. A stretch and making the rules as he goes

The Death Penalty is not allowed to be decided by judges anymore.
Only by juries..so say SCOTUS.

Judges can overturn the jury's recommendation of death and impose life instead, but not the other way around.

I think Greer is so anxious to see her dead, that he should be required to finish her off by beating her to death with his gavel. He has done everything else he could do to kill her. May he rot in Hell!

The person who removed the tube may have just been a human worm -- or a co-murderer. In essence Greer hired a hitman.

I think that Greer was sympathetic to Michael Schiavo, Felos and to the right to die movement. He found all ways possible to make sure Terri's tube be pulled .
How can anyone with common sense who looks at this case think otherwise. For Greer to say Michael proved with CLEAR AND CONVINCING evidence that Terri wanted to die when all Ms did was say he heard her say it and so did two of HIS family members. That's CLEAR AND CONVINCING after several years? Puhlease.

Also, the court appointed guardian we always hear so much about is also a lawyer who made statements in journals about this legal case and he was sympathetic to Michael's side.
YET Greer still allowed him to be the "non partisan guardian".
The Schindlers attorney filed a motion with Greer to have him removed because of his previous statements supporting MS.
Greer found no problem with his previous statements and said he could be fair.

How long have you suffered with this problem? Were you born with it?

I have always wondered if being so self-centered with a lack of empathy was environmental or genetic.

inkspur, come back-the question was serious.

Jim, I don't think it is.

" The Left may have lost the Presidency and the Congress...
They have the judiciary sown up, however. They have their propaganda mouthpiece in Hollywood. They control the press."

Amen.
A week ago Friday, Brian Williams opened up NBC Nightly News by saying that Terri " had been kept alive for 15 years-by machines."
Then he showed a video of Terri , sans machines, at a duck pond with MS.
I don't think Williams even understood the irony of his report.
Maybe he thinks a wheelchair is an artificial means of life support.

How did you get that out of Dog Gone's post?

Perhaps you could address a couple of the points he made.

"Could he order her shot?"

It would have been more humane.

"I'm thinking of starting a new thead. Should Terri be put on a US coin, or should she put on Mt. Rushmore"

Very inappropriate sarcasm at a time of such sorrow.

"A bigger minority want Terri to be the poster child for pro-life, and they've completely hijacked this forum and nearly every thread"

I think this is completely untrue, IMHO. What I see are people in disbelief that our judicial system would aid a somewhat suspect husband in murdering his innocent wife

Many people have read everything they could in order to get as complete a picture as possible. Others know very little of what has actually transpired in the past 10 years with this couple and her family, yet jump to conclusions. You see it here quite frequently when people don't see a difference between pulling a feeding tube and denying food and hydration. The later is attempting to murder the person. It has been sworn to by nurses that cared for Terri that she could swallow thickened liquids, pudding and jello without aspirating. The thought of her husband and our judicial system working hand in hand to see that she dies is very disheartening

For people to complain about these threads instead of just skipping over them and moving on is a bit ridiculous
