A person can't be pardoned when they haven't been convicted of a crime to be pardoned for.

The problem with pardoning her is that she is not being punished for a crime.
I have heard it suggested that she be declared an enemy combatant. Then they would have to take her into custody. Can't be too careful you know. And of course, we would have to respect her rights to food and medical care while she is in custody.
Don't think that will happen either.

Correct, she is not being executed for a crime, hence can't be pardoned for a crime.
She is being executed because her brain is damaged and her husband wants her dead.

Definitely the looniest scheme I've seen so far. Storming the hospice with the National Guard was far more sensible.

Bush can't pardon Schiavo because she's not the one who committed the crime here. He can, however, however do what BJ Klintoon did with Elian Gonzalez, and send armed federal agents to take custody by force and remove Schiavo to a military hospital for treatment.

The pardon power is not related to the "crime", but is to forgive the sentence. She has been sentenced to death, and the President could stop it.

I thought I'd heard all the hysterical, idiotic arguments possible on this case.
Then this thread appeared . . . . . . .
More bombastic ballast helping to sink FR this week.

And under our federalist system, he doesn' have the power to intervene within what is essentially a state matter.
This will have to be resolved within the State of Florida.

The pardon power is not related to the "crime", but is to forgive the sentence. You need to stop malpracticing law without a license. You're thinking of a commuting a sentence - a pardon does relate to the crime.

The problem with pardoning her is that she is not being punished for a crime. Right! She's being murdered,
based on a lie that her so-called husband concocted.

Give me some time...I am working on a scheme to post in Breaking News here very shortly.
It has to do with black helicopters, asteroids, Anna Kournikova, Starbucks Frenech Roast, Idi Amin and the Teletubbies.

He calls Bush fans "picture lickers." No moderation from him.
