It's got absolutely nothing to do with classifying, IV's, pacemakers, wheelchairs, insulin, or anything else you can dream up, like cheeseburgers.

It has to do with the ruling of the courts to remove all life support.

The stomach tube in Theresa is classified as life support. Like it or don't!

I know you have an argument with the courts. Do you have an argument with logic also?

Terri's husband has the right to make that decision. The court is merely affirming that right according to the LAW.

But the 14th amendment states this:

Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Section 5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.

Congress believed this to be the case. Otherwise they would not have acted.

The issues revolve around whether or not she was in a persistant vegetative state or not and whether or not, and whether or not she had a "living will".

She did not appear from films on TV to be a persistent vegetative state, nor was she permitted to be examined by physicians not under the control of her "husband", an adulterer.

There was no written document to prove any "living will" existed.

The actions and motives of her "husband" and open adulterer are suspicious and questionable.

The Judge in the Case, Greer, was apparently the recipient of campaign money from the firm representating Schiavo - or so it was so posted in this forum.

Whettemore (spelling?), the Federal Judge who reviewed the case, was from the Florida court system and was reviewing the actions of his collegues.

Congress passed a law directing the Federal Courts to review the case de novo - an action they blantantly and defiantely ignored.

I haven't been following this adventure ~ so it isn't appropriate for me to comment, except to say that if I was in this state and hadn't responded in a couple of months, I would want them to release me from my earthly bonds and be with the Lord in Heaven.

Get a living will. And the matter is more complicated. All in all you have a point, as long as the person that decided to release you from your Eartly bonds decided to do it right then instead of waiting eight years and then finally deciding you told them to do it.

Agree 100%...

Listen... What I would have liked to seen happen was the Congressional Subpoenas work... I WANT SOMEBODY TO SEE FIRST HAND how "out of it" this girl is... no video tape... no editing... No third hand testimony... just her... live & in person...

It seems like a lot of effort has gone into HIDING her from sight. I want to see this happen because I went to college with somebody who looked to be in a very similar condition as terri... He could barely speak (He sounded a lot like chewbacca... You could understand him if you listened carefully)... He couldn't walk... He couldn't really control his head or arms... Not sure if he could eat on his own.... certainly not without a lot of help... but there he was, every day, with his dad, IN COLLEGE... MAKING A POSITIVE CONTRIBUTION... Taking College classes.

I fear that the state of Florida would have pulled his plug a long time ago.

There has been seven years of "due process of law," in this case. The fact that you do not like the result does not alter that. And appeals on any 14th Amendment issue have already been had to the Federal Courts.

While I, as many other Conservatives, through the years, have challenged the ratification of the 14th Amendment, your point has already been litigated, by Courts that accept its validity. Today's action by the Supreme Court, in not hearing the case, is not the first time they have chosen not to hear the case, which by implication lets the holdings of the lower Courts stand as the Law of the case.

Obviously the government, the courts, the lawyers and everyone and their brother are in a quandry over this.

Of course this is only the third or fourth time they have "pulled the pug" on Theresa.

Hell, let's just keep doing this until we all die of old age.

We can all meet here in two years, when they do it again, and hurl oaths at each other for a couple months. ;)

(I realize this is no laughing matter. I'm just smiling a little.)

If Terri Shciavo were NOT in a hospice... if she was a happy healthy 40 year old woman, and suddenly turned up dead, the police would certainly want to know if Mike was having an affair (let alone had two children by another women) because it is MOTIVE to kill your spouse!!! Is it EVIDENCE of wrongdoing? No, but its enough to say "Sorry pal, you gave up your right to decide whether she lives or dies."

Some people just want everything to be so convenient to the living that it doesn't matter. It's a shame. And a decision they can live with when the dirt surfaces. And you can bet it will. It'll be too late, but it'll surface.
