My children were given custody of our pets, and I got custody of the children. The arguement was "you're not seriously considering taking these pets away from your children?"

Though our judge was weird. I got custody of the computer desk!! LOL

You need to call your lawyer.

If he violated a temporary joint custody agreement then something might be done. If you have no written agreement then you may be up a creek.

In a lot of states, if you have the dog's rabies tag then you are considered the owner. Period. My boss was taken to small-claims court over ownership of her pug and this is how it was worked out. (She won.)

Divorce courts/judges are quite used to ordering custody for animals. Rose bushes are another matter. Anyway, I was awarded custody of the cat population, but my cat-hating x-husband refused to hand them over and I was absent the marital residence under a protection order. That made it a bit difficult, but I took my paperwork, headed to the marital residence and had the neighbor knock on the door. When the x opened said door, I marched in and proceeded to stuff kitties into their respective carries. The x called the police. The police laughed since (i) he had opened the door; and (ii) I had the appropriate paperwork; and (iii) he was supposed to stay so many yards away from me and he failed to back away from the door when I passed through (or at least that's how the police officer saw it). Actually, he got himself arrested because he started threatening me in the presence of the police officers (said things that shocked the kitties).
