As long as she lives, there isn't enough evidence to indict him, much less convict him of abuse or attempted murder. Even if she miraculously recovered, and that would be as miraculous as someone growing an new leg, her testimony would be devalued by the documented brain damage and inadequate to convict.
Once she is dead, an autopsy will provide plenty of evidence, and then the charge will be capital murder.
And neither he nor Judge Greer has the ability to stop an autopsy or Coroner's Inquest.
The money won in the settlement is almost entirely gone and if there is any insurance you can bet they will demand an autopsy before they pay.
Under your scenario, he has nothing to gain, and everything to lose by her death.

Oh no, Once she is dead, Michael Schiavo has ORDERED her IMMEDIATE cremation. He will not even allow her parents to have the ashes. They are being sent to Philadelphia where she was born. This man is a criminal. He abused his wife as reference by Affidavits. And all the evidence you say you require, does exist but Greer, refused to admit ANY evidence from the Schindler side of the trial. NOBODY can make a proper, let alone Just ruling on one side's evidence. Michael Schiavo, the day of the collapse, called her father, who rushed over and HE had to call 911. Michael Schiavo was sitting on the couch reading a magazine.!! It's interesting to note that he and Terri had had a fight that day she had asked for a divorce. Her girlfriend asked that she stay overnight with her and not go home that night. Terri said, "Oh I'll survive", she was disabled the very next morning.!! This man is 6'6" 250 pounds. Terri was a tiny little thing about my weight only a little taller. If the man was innocent WHY would he not allow ANY tests to be done? Some of the Neurologists who want to examine her simply CANNOT believe that she has never had an MRI or another test that escapes my mind at the moment. Terri also, does not drool, she can swallow, once a nurse fed her some jello - she was fired. There is so much to this case that is WRONG that it is not fair to compare it to cases where someone is dying of a terminal illness. Apples and oranges. Dr. Hammersfar, a nobel prize nominee, neurologist, DID examine Terri and she could follow commands, attempt to answer, laugh, cry, etc. etc. He has stated along with others, that they HAVE successfully treated cases like Terri and have had great success. These Doctors are also not asking for money. There were 17 board certified neurologists who submitted Affidavits on behalf of Terri and Greer, REFUSED to even review them. And incidentally, Greer is Legally blind. I'll bet he studied reports real thoroughly. Actually he had to have the ones he wanted to hear, read to him. He is not permitted to drive a car. Geez, he's rather disabled don't you think? Perhaps they should starve and dehydrate him to death. He's disabled. That is all that appears to be his qualifying factor for death. Truth is, THIS case is different. Florida needs a good house cleaning. Even the Hospice or group of them (Suncoast Hospices) is now under investigation by a Forensic accountant and other law enforcement for medicaid/Medicare FRAUD to the tune of Fourteen million dollars. All of these Hospices are run by one Mary Labyak who has a criminal record because of her "creative" bookkeeping. I suspect that Terri won't get Justice on this earth but nevertheless, Justice will be done.

Evidence is different from hearsay. They hired an incompetent lawyer and they lost, it happens every day. Get used to it.

Hammersfar neglected to submit a written report at the original trial.
The others came into the case later, after it was legally too late.
You only get one bite at the apple.
Under our legal system it would be WRONG to review affidavits submitted after the decision had been reached unless there were OVERWHELMING evidence of a faulty judgement.
Greer is just a hard headed practical judge following a law you hate and you are drowning in a conspiracy theory developed over 15 years by deluded parents wallowing in their own guilt for screwing up the case, and now aided and abetted by Randall Terry, a bomb throwing -right-to-life lunatic. If these people get their way, there will be no withdrawal of treatment of any kind for any reason ever.
That is what the Hose Bill amounted to before it was ammended to meaninglessness.

This is the reason for an autopsy Michael Schiavo done an MRI years ago this NATIONAL DOUBT would not be hanging over his head!
My husband died as a result of many mistakes by the hospital, but no medical examiner cared or ordered an autopsy. If I wanted one I would have had to pay for it, and I could not afford it, so he was cremated. I said to do that (he wanted cremation).

Attended early Church and it was wonderful. It was so good to just GO this year. :)

Slow here this morning, I think that most who might be around are fighting battles on the Terri Schiavo threads. Sounds like you're having a lovely Easter so far. I'm going to run out in a few minutes and go to the nursery. Need to buy some seeds, small pots to transfer tomato seedlings into. They're in peat pots right now, and need to placed into somewhat larger pots with some potting soil.
