Prove it in a court of law beyond a reasonable doubt?
What actual facts do you have?
Not just rumor and gossip and inuendo.

We are a Nation of Laws, not necessarily justice.
We don't even have a theoretical idea of how to make a Nation of Justice actually work.

Terri Schiavo's father testified under cross examination that he would cut her arms and legs off and put her on a ventilator to keep her alive. He sounded like a lunatic and he sounded unfit.

The one neurologist who examined Terri who says, now, that someone might still be in there, this is the Nobel Prize winner, neglected to file a report with the court. Either he was unwilling to say it in writing, or he was just a loon. In any case, her parents lawyers did nothing to follow up.

Her parents lawyers also neglected to get an attorney ad litem appointed for Terri, and neglected to appeal the Judges ruling on that issue in a timely manner.

Michael Schiavo had three other people who testified to hearing Terri Schiavo say she would not wish to live under those conditions.

Under those circumstances Judge Greer had no choice but to rule as he did. The correctness of his ruling at law is shown by the fact that he has been upheld close to 30 times on various appeals.

If you don't like how things are turning out, get the Flori-duh legislature to write new laws to govern these situations in the future. Don't blame the judges for applying the laws as now written. So9

Well her bone scan as per Dr. Baden, showed evidence of strangulation. He also stated that it was "very unlikely" that any potassium imbalance was the cause of her collapse. Her bone scan also showed MULTIPLE fractures in different stages of healing.

There was a criminal complaint filed and Sheriff Rice, a contributor to Greer's campaign, REFUSED to even open a file. It goes on and on George. I'm not against terminally ill patients being allowed to pass away with no "heroic measures" carried on. Starving and Dehydrating? - NO WAY!! Besides, she's NOT dying. And what about the misappropriation of the Jury Award? It was earmarked specifically for REHABILITATION for Terri with a life expectancy of 50 years. Instead he has pissed it away on himself and his freak Lawyer that thinks he can crash airplanes with power of his mind. They are all involved in the Hemlock group George. THIS case really does have legitimate issues that needed looking into? Schiavo has broken EVERY single statute applying to a Guardian in the State of Florida. I agree with you on one issue tho - the Schindlers needed more effective legal representation. But if you REALLY get into this case and see where the major players are in collusion it would shock you, or should. In fact, what the HELL is she doing in a Hospice anyway? And instead of the money from the award paying for her care, Medicare has been being bilked illegally for years. Did you know that when this "transfer" from a Hospital to a Hospice took place that George Felos just happened to be the Chairman of the Board of Directors for the Hospice to which she was transferred. And in keeping with "the Law", NO Medical doctor SIGNED her transfer form. The entire thing stinks to high heaven.

Shilling for the culture of death is shameful. George, you should know better than to cheer this travesty on. To think that the husband is anything but a money hungry bastard is not worthy of your intellect. To have studied the court rulings without realizing how bad they are is not much different than believing the Florida court was right in 2001. To think that all the facts are on the husband's side is simply a willingness to be fooled. This is complex, but the crux is that the court has been wrong from the original "fact finding". This from Powerline:

Steve Sailer reproduces a letter from a Florida lawyer, who comments on how the seemingly perverse outcome of the Terri Schiavo litigation came about:

I have been following the case for years. Something that interests me about the Terri Schiavo case, and that doesn't seem to have gotten much media attention: The whole case rests on the fact that the Schindlers (Terri's parents) were totally outlawyered by the husband (Michael Schiavo) at the trial court level.

This happened because, in addition to getting a $750K judgment for Terri's medical care, Michael Schiavo individually got a $300K award of damages for loss of consortium, which gave him the money to hire a top-notch lawyer to represent him on the right-to-die claim.

By contrast, the Schindlers had trouble even finding a lawyer who would take their case since there was no money in it. Finally they found an inexperienced lawyer who agreed to take it partly out of sympathy for them, but she had almost no resources to work with and no experience in this area of the law. She didn't even depose Michael Schiavo's siblings, who were key witnesses at the trial that decided whether Terri would have wanted to be kept alive. Not surprisingly, Felos steamrollered her.

The parents obviously had no idea what they were up against until it was too late. It was only after the trial that they started going around to religious and right-to-life groups to tell their story. These organizations were very supportive, but by that point their options were already limited because the trial judge had entered a judgment finding that Terri Schiavo would not have wanted to live.

This fact is of crucial importance -- and it's one often not fully appreciated by the media, who like to focus on the drama of cases going to the big, powerful appeals courts: Once a trial court enters a judgment into the record, that judgment's findings become THE FACTS of the case, and can only be overturned if the fact finder (in this case, the judge) acted capriciously (i.e., reached a conclusion that had essentially no basis in fact).

In this case, the trial judge simply chose to believe Michael Schiavo's version of the facts over the Schindlers'. Since there was evidence to support his conclusion (in the form of testimony from Michael Schiavo's siblings), it became nearly impossible for the Schindlers to overturn it. The judges who considered the case after the trial-level proceeding could make decisions only on narrow questions of law. They had no room to ask, "Hey, wait a minute, would she really want to die?" That "fact" had already been decided.

I can't comment on the quality of the work done at the trial level without reading the transcript, but in general, what this lawyer says is correct. The reason why appeals don't often succeed is that all fact-finding is done in the trial court. If there is evidence to support the facts found by the judge or the jury, those facts are set in concrete from that point on. The question on appeal is only whether proper procedures were followed and the law was correctly applied. It is not hard to imagine that the Schindlers had no idea what they were getting into, and were ill-equipped, financially and otherwise, to fight a legal battle against their son-in-law. By the time they started garnering outside support, it was too late.

The "facts" are not as you are saying George. I respect your ability to put things together, but when you become a virulent pull the plugger you sound no better than Andrew Sullivan shilling against W because of his gay rights position.

I am sorry you think so, but I truely believe the Judge made the right decision based on the evidence presented to him.

It would have been a Judicial Overreach as wrong as the Supreme Court's 'right of privacy' decision for him to have found otherwise. It would be equally outrageous for any of the superior courts to have overturned him.

If you don't like the decision, change the law it was correctly based on.
I however will be on the other side. I will give my life if necessary to defeat this evil cult of mandatory suffering forever that Randall Terry and his goons are using this case to forward. They are trying to reverse twenty years of progress in gaining the right to die with dignity.

We haven't gone far enough yet. Anyone without a Living Will specifying they are to be kept living must remain at the control of their guardian. Death is not a sufficient option. I demand death with dignity. Anyone should be able to specify the conditions under which they or their guardian will be supplied a massive dose of morphine to finish them. That is a right of almost anyone with a doctor in the family and denied the rest of us.

I had to watch my father die of dehydration because the right-to-life thugs refused to let me put him away as he wished, instantly, without facing prison.

I will not go through this with another loved one. I will not go down without taking a lot of people with me.
