The way the already passed House version is written will make Living Wills almost impossible if challenged by any relative, no matter how distant or kookie or ill intentioned.

And he has made plans to have her cremated immediately after her death .. with no autopsy

The difference is that now if a family member also has your durable power of atty and agrees, your wishes will be carried out. Under the new law, any relative can take it into "Federal Court for years, no matter what paperwork you have drawn up.

The Senate version is not the same as the house and it is my understanding the Senate wouldn't agree to the house version
Which is why it was sent back to the house of reps

My husband did not want rehab for feared nuring home which I would not allow, but my health was not able to in all reality take care of him at the time....
So even though I was in a quandary he could have checked out!
he ask me to stay but I told him I would see him in the morning so either he knew he was leaving or just died I don't know.....but the doctor told me he was going to move him to another place for rehab and another told me when I asked if he was dying I did not get a straight answer only telling me about his rehab in the AM and also saying somethng about his heart muscle was only 30 or 20%.....boy was I out of it it never registered!
I had too leave because I did not want him to see me cry and upset him I was trying to be strong!

No, and the Senate version is worse. It allows any relative to prevent ending stopping any kind of treatment, not just life support. Any relative, no matter how nutso or evil can take you to court and force you to continue chemo or radiation treatment on a cancer victim long after there is no hope and they should be allowed to die in peace.
If Terri dies soon, this will all drop in the great legislative black hole with the Flag Burning Ammendment. Otherwise it will get passed in a week and be law for 2 years until anger over it gives the House and Senate both to the Dems.

All judges are supposed to do is follow the law, and they did.
No, anybody can't sue anybody. You have to have 'standing' to bring a suit or it will be dismissed. That is why Terri's parents always lost, they didn't have standing. What this new law does is give any relative, no matter how distant 'standing' to sue the spouse to stop their deciding things.

Eventually judges always stop hearing new petitions on a matter, otherwise no case would ever end.

This is bad law being stampeded into place to save one woman no matter how bad it is.
