No, I think each network is holding off declaring enough states to be the one to declare Bush the winner. Fox and NBC declared Ohio for Bush, so they hold off declaring a NM or Iowa. The other networks have a different mix of undeclared states. Even with 99% of the vote in and Bush with a clear lead.
He threatened to vote against Bush as a protest, but unless he votes for Kerry, it still goes to the House. I think his intention was to vote for someone else as a protest and not if it altered the outcome.

If they call those states they have to give the race to GWB. They just can't bring themselves to do that yet.

Bush wins this, I think, with 286 EVs, no doubt.
But it's clear that the GOP needs to win every state by 5% or more to avoid dem whining. :-)
New Mexico had this problem last election. They have a large number of absentee votes. That being said, I think they could call the state for NM, but the Kerry campaign has probably asked them to hold off to ease the speculation that he should concede now rather than later. He's just buying some time.
Someone more familiar with the law and constitution will have to comment but that renigade elector would have a tough time justifying going first against the voters of his state and then against the majority of Americans. It would seem a legal challenge could be made that he was disenfranchising millions of voters.
By not calling the other 4 states, they can try and skew things to have those states go to KERRY.

The Bush campaign and the White House has their own election team of experts and they know that the President is gonna carry Nevada, New Mexico and Iowa. This is over.
The media is covering for Kerry to the bitter end by refusing to ackowledge Bush's victory in New Mexico and Iowa- NO ONE IN THE 4th ESTATE is willing to put Bush over the 270 electoral vote total!
Apparently the New Mexico and Iowa SecStates will have to make the announcement.
Who exactly cares what the networks call or don't call. They have made their own commentary obsolete by providing real election results on the internet in real time.
I spent several hours last night following Florida counties. As soon as the big dem counties started reporting I knew Bush's margin was safe. I didn't need any help from the networks. It was simple math done on the Windows calculator.
Later in the evening I was able to do the same thing with Ohio. I know absolutely nothing about Ohio politics, but by doing a bit of arithmetic on partial returns I could see that Cleveland wasn't going to save Kerry. All you have to do is take the partial percentage of any big county and project that percentage to the total votes cast. You then know whether that county can flip the election. In the case of Florida, it was three big dem counties, but the math was sixth grade level.
So the expert commentary has been made obsolete by the web and it's ability to display detailed information faster than pundits can talk.
