A Coppell High School social studies teacher surrendered to police Wednesday and was arrested on a felony charge of sexual contact and indecency with a child.

Duane Masengill, 34, was suspended from his job Jan. 14, when a student filed a complaint with Coppell police. According to the arrest warrant, a 15-year-old girl said she had sexual contact with Mr. Masengill during a 7 a.m. tutoring session the previous day at the school.

"He vehemently denies the accusations," said Mr. Masengill's attorney, Ted Steinke of Dallas.

Mr. Masengill, an eight-year employee of the district, posted bond and was released. He remains on paid leave from the district.

Tamarah Ringo, Coppell school district spokeswoman, said the arrest was the first in the district in recent memory.

"All of our teachers have criminal background checks," she said. "The last checks were completed in December." She added that his record was clean at the time.

Mr. Masengill, who contributed a geography quiz to The Dallas Morning News' travel section for several years, lives with his wife and young child in Little Elm.

Mr. Steinke said it could be as long as a month until a grand jury hears any evidence in the second-degree felony case.

If he is not convicted, school officials would determine whether there was a faculty position for Mr. Masengill, said Judy Denman, the district's director of human resources.

Mr. Masengill's position is being filled by another teacher indefinitely, officials said.

"This is the kind of thing that has a ripple effect throughout a school district," Mrs. Ringo said. "Our first priority is to take care of our students and staff."

It's not negligent when they do it on purpose.

If it turns out that he is not guilty, he has a solid civil rights action against the police; and the girl. If the school were to not give him his job back, he has a claim against it as well.

When my 40ish year old daughter was a senior in high school there was a 30 year old male teacher who was always REAL friendly with the cheerleaders. One Summer he and a 17 year cheerleader old ran off to Canada together. Last I heard they are still married and have several kids.

He was hardly a child molestor but still it just didn't seem right.

If this Massengill guy is guilty he should be punished though because he is an authority figure.

Well, if so, what a shame then, that a (young) person can likely ruin another's life with such disregard.

Caught on KLIF that the accuser had been doing poorly in this teacher's class, and that she had accused another teacher of improper conduct when she was failing his class.

Sounds like we've got a case of crying wolf here.

Teenaged girls often lie for attention and publicity. I don't necessarily buy this. That is why no man should ever be alone with any female or male in any professional situation, ever.

All should remember innocent until proven guilty. The truth will come out and a countersuit will be in order for defamation and the damage this wrecked on a very professional and well respected career.

Most of these posts are really old so for you naysayers. The fact of the matter is that he wasn't in that room alone. There was someone else who was in there.

Coppell teacher indicted on child indecency charge

COPPELL – Just months after a grand jury declined to indict a popular Coppell High School teacher on allegations of sexual misconduct with a student, another panel on Thursday charged the teacher with indecency with a child by sexual contact.

Duane Masengill, 35, had not been arrested Thursday, but a warrant was expected to be issued for his arrest by this morning.

Indecency with a child by sexual contact is a second-degree felony. If convicted, Mr. Masengill could face up to 20 years in prison and a $10,000 fine.

A spokeswoman with the Dallas County district attorney's office declined to say why prosecutors had revived the case. She said evidence presented to the grand jury was confidential and could not be released.

"We discovered new evidence and found it necessary to re-present it to the grand jury," Rachel Horton said.

She added that grand jury reviews of cases that were previously rejected are "relatively unusual, but in this case we felt it was the right thing to do."

Coppell police Deputy Chief Gary Nix referred all questions to the district attorney's office.

Mr. Masengill's attorney, Ted Steinke of Dallas, a former state prosecutor, said his client will plead not guilty.

"He was devastated to learn the news, but he's not going to run," Mr. Steinke said.

The allegations of sexual misconduct surfaced in January when a 15-year-old student told investigators that Mr. Masengill had fondled her during tutoring sessions and asked her for sexual favors in exchange for better grades.

A police report provides a graphic account of the incidents, which date to late November or early December 2003.

According to the report, in one incident Mr. Masengill kissed her, and "from that point on when the class took a quiz or a test, the defendant would offer her a better grade during tutoring if she would do something for him."

It also said the girl performed sexual favors for Mr. Masengill.

When questioned by police, Mr. Masengill denied the allegations and asked to take a polygraph test. In January, he was put on administrative leave with pay.

The incident has befuddled the school district and infuriated many students and parents, who steadfastly insist that Mr. Masengill is innocent and have come out again to support him.

At a news conference Thursday afternoon, Coppell school district Superintendent Jeff Turner called Mr. Masengill an outstanding teacher and said the district officials and teachers supported him.

"You are innocent until proven guilty," he said.

Dr. Turner said he was saddened and disappointed by the grand jury's decision.

"Our heart goes out to Mr. Masengill and his family," Mr. Turner said to a roomful of students and reporters gathered at the district offices.

Dr. Turner said he had not talked to Mr. Masengill but would be "talking to him in the near future."

The indictment comes two weeks before Mr. Masengill was scheduled to resume his post, teaching pre-AP geography to freshmen. He also was going to teach one regular geography course.

Dr. Turner said the teacher had been placed on administrative leave with pay. The school district would determine whether to fire Mr. Masengill if he is found guilty, Dr. Turner said.

He added that district teachers and administrators have drafted a set of guidelines to protect teachers and students.

Tenth-grader Matthew Tsang, 15, a former student of Mr. Masengill's, said he was shocked by the allegations. He defended Mr. Masengill as a creative educator who challenged students and "gave us a sense of fun in school."

Minta Hallman said Mr. Masengill was one of her favorite teachers and was popular among students, many of whom would come to him to talk about hockey.

"He's a real big hockey fan," said Minta, 17, a senior. "He loves the Stars."

Maryanne Visconti, a former Coppell elementary and high school teacher, said Mr. Masengill "lives and eats teaching."

She said the student should recant her story.

"I am convinced she is not telling the truth," Ms. Visconti said.

Attorney says Coppell instructor will fight allegations in court

A Coppell high school geography teacher accused of fondling a 15-year-old student surrendered to police Friday and was arrested on a charge of indecency with a child by sexual contact, a day after a grand jury indicted him.

Duane Darren Masengill, 35, of Little Elm had his wife and attorney by his side when he turned himself in at Lew Sterrett Justice Center in Dallas at 2 p.m., said Dallas County Sheriff's Department spokesman Sgt. Don Peritz.

Mr. Masengill was walking with crutches and was wearing a leg brace to help heal a hockey injury. He is said to be an avid fan of the Dallas Stars.

Sgt. Peritz said Mr. Masengill was calm and was seen by the jail nurse. Sgt. Peritz also said a DNA sample was taken from Mr. Masengill when he registered at the jail.

His Dallas attorney, Ted Steinke, said: "The law requires that when an individual is indicted with indecency [with a child by sexual contact], he must submit a DNA sample as a condition of his release. It's mandatory."

A judge set bail at $25,000, and Mr. Masengill was expected to be released Friday evening.

The charge is a second-degree felony, and conviction would bring up to 20 years in prison and a $10,000 fine.

Mr. Steinke said his client is going to plead not guilty and fight the case.

"I intend to vigorously defend this case and take it to trial," Mr. Steinke said.

Allegations of sexual misconduct against the popular ninth-grade teacher surfaced in January after a student accused him of fondling her and asking for sexual favors in exchange for better marks.

Mr. Masengill has denied the accusations. He was placed on paid leave by the district until the case is resolved.

The teacher, who has taught world geography for eight years at Coppell High School, was making $38,675 during the 2004 school year, district spokeswoman Tamerah Ringo said.

A grand jury declined to indict him in early March on the same charge of indecency with a child by sexual contact, but the district attorney's office presented the case to another panel, which indicted him Thursday.

A spokeswoman with the district attorney's office said investigators revived the case because they said they had found new evidence to build their case against Mr. Masengill. Rachel Horton said she couldn't discuss what that was because of confidentiality requirements.

Ms. Horton said it is unusual for previously rejected cases to be revisited, but prosecutors felt it "was the right thing to do."

Coppell city spokeswoman Sharon Logan said Coppell police investigators had not provided new evidence in the case.

A police report dated Jan. 29 shows Mr. Masengill denied the allegations and said he wanted to take a polygraph test. Mrs. Logan and Ms. Horton declined to confirm whether he had taken the test.

The grand jury indictment Thursday came just days before Mr. Masengill was to resume his post as a pre-Advanced Placement teacher at Coppell High School. Mr. Masengill has taught world geography for eight years at the school.

Coppell ISD Superintendent Jeff Turner has said the district supports Mr. Masengill. He has said he is an "outstanding" teacher.

He was on crutches, due to a hockey injury.

COPPELL, Texas - Dallas County prosecutors Monday dropped their case against a former Coppell teacher who had been charged with indecency with a child. Prosecutors decided not to try Duane Masengill just moments before the trial was set to begin on Monday morning. A 15-year-old girl had accused him of trading grades for sexual favors.
Officials told police that they are unable to locate the girl who had made the allegations against Masengill.
"He was looking at up to 20 years in a penitentiary if a jury somehow believed what the complainant was saying," said Ted Steinke, Masengill's attorney.
They said the girl, who had been in the custody of Child Protective Services, ran away about a year ago and has not been located.
Prosecutors needed her testimony in court to make their case.
"It's going to take a healing process for me, without a doubt," Masengill said.
Masengill enjoys overwhelming community support.
"I think that's absolutely wonderful. We felt like he was innocent, and we're so excited that maybe he'll be able to be put back in the classroom where he belongs, with the children," said Olivia Cangelosi, a parent.
"Just given the track record, the reputation of that man, it seems very unjust what was done to him and his family," parent Monte Daily said.
The question is whether Masengill will want to return to the school where it all began.
"This is every teacher's worst nightmare and, unfortunately for Duane, this nightmare has lasted two years," Steinke said.
The Coppell Independent School District said a job is waiting for Masengill if he wants it.
Investigators said Masengill's accuser has also made allegations of abuse against her stepfather and a foster parent. Charges against both have also been dismissed.
