State officials are trying to determine whether hundreds of Virginians erred - or fibbed - when claiming a state tax deduction intended for Medal of Honor recipients.

Only four men in Virginia have received the medal, which is the highest citation granted to American military heroes. But 642 people claimed the state tax deduction when it was offered for the first time in 2001.

These are the laws pertaining to the illegal wearing/sale/manufacture of decorations and medals, and the laws governing the illegal wearing of the uniform of the United States Military. See Sec. 704b for the MOH.

Now since all but 4 are improperly claiming MOH status the odds are that they bought the medal from someone (jail-house check in there), have and wear the medal (jail-house check ins there), it's time to enforce just that State of Virgina.

However, tax department officials acknowledged it would be difficult to prosecute anyone for fraud because it is too hard to prove the intent to deceive.

They lied on their tax forms, what more 'intent' is needed? It's not like when they went to sign their tax form they had to pause for a bit. "Hum, am I a MOH recipient? I can't remember, so I'll just check 'yes'.

This is fraud, plain and simple.
