The New Mexico legislature is considering what appears to be an unconstitutional bill, SB17. The bill creates considerable red tape and record-keeping requirements for gun dealers. It also bans the sale of numerous common firearms by simply requiring that dealers be forbidden to process background checks for those firearms. New Mexico requires dealers to run background checks for nearly all firearm sales.
Excerpts of the bill from nmlegis.gov:
A. Beginning on July 1, 2026, a dealer shall not sell or transfer any of the following firearms, ammunition or devices to a person who is not licensed pursuant to 18 U.S.C. Section 923, nor shall a dealer process a background check pursuant to Section 30-7-7.1 NMSA 1978 for the transfer of any of the following firearms, ammunition and devices between parties that are not licensed pursuant to 18 U.S.C. Section 923;
(1) a detachable magazine that holds more than ten rounds of ammunition;…
(4) a gas-operated semiautomatic firearm that can accept a detachable magazine;
(5) a gas-operated semiautomatic firearm with a fixed magazine that holds more than ten rounds of ammunition;
SB17 has seven sponsors as of this writing. There are six women and one man. Senators Micaelita Debbie O’Malley, Andrea Romero, Heather Berghmans, Charlotte Little, Patricia Roybal Caballero, and Peter Wirth. They are all members of the Democratic Party. Senator Peter Wirth is the Majority Floor Leader. Republicans in the New Mexico House are asking the federal Department of Justice for help.

Hasn’t bills like this been deemed unconstitutional in other states by The Supreme Court?
It’s my state of NM.
Beautiful state.
Highest welfare and gubmint workers of all states, I believe. (Not sure on welfare; Mississippi used to beat us.)
But for the fact the Apache reservation (home to my wife) is there, I’d be long gone.
Yes, but we have the Spirit of Aloha which trumps the Constitution.
(Yes, I know that’s Hawaii and absurd. But pretty much sums up the government.)
The Supreme Court precedent is clear, but they have not ruled on a semi-auto ban directly, yet. There are several court cases heading to the Supreme Court. Justice Alito said they would take a semi-auto case in “the next term or two” last term.
This is open defiance of the Supreme Court, similar to what the South did in opposing racial integration of schools.
The communists just keep coming.
They are doing this in Virginia too. It looks like they have to grandfather guns and magazines people own before the law takes effect. I assume there will be a run on guns and magazines.
The guns and magazines they are banning are some of the most popular guns and magazines in the USA.
Don’t comply. These are illegal laws created by tyrants.
“Hasn’t bills like this been deemed unconstitutional in other states by The Supreme Court?”
I’m reasonably certain it has. What we are witnessing is legislation as performance art. Imagine how much administrative and legal “overhead” costs are being generated to process and then fight for absurd performance art legislative pieces. Also, what serious problems that should be addressed are put aside to get points from the crazy screaming liberal base?
They cannot help channeling their inner totalitarian. The ban is not popular, it is unconstitutional, and it makes no sense.
It is all based on false premises and lies.
Therefore, the Left feels compelled to push it.
I guess.. “Never give up the con.”
They can confiscate my AR after I run out of ammo.
So belt fed is cool?
I am aware of that. I lived in Colorado when Magpul left due to the magazine restrictions.
Funny that these states never ban Hollywood films or television shows that include use of the weapons they ban! Its reminds me of pukes like Liam Neeson making millions playing a heroic character who is as gun happy as John Wick but then preaches anti-second amendment garbage.
The point of the new law is intimidation.
While proving innocence in accordance with the second amendment, you will suffer and perhaps succumb to the New Mexico state lawyers.
To prevail, one must eliminate the state lawywer from the process
How many leges do the cartels own?
Yes. They don't care. It's all about pandering to their idiotic base and also tying up legit gun sales and ownership in the courts.
Democrats feel safe passing these laws knowing they will be overturned and they can then selectively enforce them.
