During testimony behind closed doors, former special counsel Jack Smith told lawmakers he believed he could prove President Donald Trump engaged in a "criminal scheme" in order to overturn the 2020 election. NBC News' Ryan Reilly reports on Smith's investigation and what members of Congress had to say.
Summary
Former special counsel Jack Smith testified in a closed-door House Judiciary Committee hearing on December 17, 2025, after being subpoenaed by Republicans. He defended his investigation into President Trump's efforts to overturn the 2020 election, stating that his team found proof beyond a reasonable doubt of Trump's involvement in a criminal scheme. Smith emphasized that he believed the case was strong and could have resulted in a conviction had it proceeded to trial, but it was dismissed due to Justice Department policy against prosecuting a sitting president, not due to lack of merit.
The hearing was held privately despite Smith's request for a public session, which Republicans denied. Democratic Rep. Jamie Raskin commented afterward that Chairman Jim Jordan made a wise decision in keeping it closed, as a public testimony would have been devastating to Trump and those involved in January 6 activities, citing Smith's report and indictments.
Reporter Ryan Reilly (likely intended as Ryan J. Reilly) noted that Smith maintained the investigation was conducted properly. No significant leaks from Republicans emerged immediately, and limited public reaction from Republicans or the Trump administration was reported at the time. Smith anticipated potential selective leaks but appeared to handle the session effectively on the public relations front.

Yes. The psychopath lies freely and often.
“We have put together the most extensive and inclusive voter fraud organization in the history of American politics”—Joe Biden, October 2020
It was the other way around. The leftists did overturn the 2020 election.
It’s not illegal to try and overturn an election. The Congress and Courts have mechanisms for doing just that, and Trump attempted to use them to the fullest.
Trying to expose vote fraud is not a ‘criminal scheme’
If he really had something, he would have hand delivered it to the nearest media buddies. Don’t believe a word Smith says. Remember, he resigned to save face because President Trump publicly stated he’s gonna fire the Smith when he took office.
I hope he does some jail time.
Is anyone else reminded of Rasputin when they see a photo of Jack Smith? Evil just rolls off of their being. Gives me the creeps.
He’s delusional.
I suspect that Jack is lying to us.
Smith is lying like his life depends on it.
How much money did they spend on an investigation into something which they (apparently) had no intention of pursuing?
Yes, in Smith’s twisted, globalist marxist mind, he can “prove it” under any absurd stretching of any number of laws - just like impeachment #1.
Show me the man, and I’ll show you the crime.
Scumbag says what?!?!
See the problem for Scum is that he doesn’t cite a statute or specific law that he thinks Trump violated that actually APPLIES to the alleged offense. He just picks and chooses and figures a friendly DC Court will play along. Like Scum did to the VA Governor and his wife, he cobbles together a little of this and a little of that to create an offense.
It amounts to no more than creating an offense out of being the opposition to Scum’s preferred political party.
Last time he did this, the Supreme Court overturned his work 9-0 and that Court included Ruth Bader Ginsburg.
“I hope he does some jail time.”
I hope I win the powerball, (and I don’t buy tickets).
Both things have the same chance of happening.
The Dan Rather lead filled life vest.
Jack who?
