President Trump is basically saying, “I respect the opinion of the SCOTUS. You district court judges are inferior to the SCOTUS, or equivalent to my appointees.”
They want a constitutional fight?
This administration will not “facilitate” importing illegal aliens into our country.
Translation to spoken English means what?
A. Trump is NOT going to push El Salvador in order to ‘facilitate’ having Garcia sent back here?
B. Trump IS going to push El Salvador for this outcome?

What’s really ironic about all this is that in 2019 the deportation order was given - to anywhere but El Salvador because there was reason to believe his life would be in danger from gangs if he went back there - but later that year Bukele was elected President and by imprisoning the gang members he made El Salvador one of the safest places anywhere. Safer than the US, if I remember correctly.
The real issue here is whether he is a ranking member of MS-13. Two immigration judges agreed that the Maryland county’s informant was reliable and trustworthy, and confirmed Garcia’s membership and his rank. These things are NOT just based on him wearing a Chicago Bulls hat or hoodie, as media accounts claim. This is a mole within MS-13 that is regularly used by that county to find and prosecute MS-13 members.
When ICE detained him this last time, they showed him a photo of him playing basketball - most likely with MS-13 members identified by this informant - and asked him about his frequenting a particular eating establishment (again, most likely associated with a known gang member). This informant would be familiar with both the ranks of people and with the non-verbal communications the gang members regularly use, and could interpret those and use them to provide other leads that those county investigators could then verify. And the immigration judges confirmed that this informant was known to be tried, tested, and true. This is NOT what the media makes it out to be, with the help of the wife and lawyers who of course say he is innocent.
I don’t doubt that the gangs were bad in El Salvador. In the 2019 immigration hearing Garcia claimed that his family moved twice to try to get away from the harassment by 18, the chief rival of MS-13 - once just 10 minutes away from their original home and once to Guatemala. He claimed the gang followed them to Guatemala.
So I ask myself why he would become a part of MS-13 if his own family experienced so much at the hands of a rival gang. The only thing I can think of is that he thought he could make sure it would never happen again by being in a gang that would protect him. If he was a ranking member he was not one of the grunts doing the killing any more. He was the one giving the orders.
I’ve done a lot of reading today, to understand how they identify gang members. There are general clues but law enforcement obviously doesn’t want to tell gang members what they are looking for so they learn to use other ways of identifying themselves. Having a mole to rat people out is the best way to get actionable intelligence. But what that mole testifies to is necessarily kept hidden, or else they will be in danger. That means that the general public will not be able to see the strength of the evidence and the accused may not be able to even know all the evidence against them. For sure it gives cover for lawyers to claim that no evidence was presented in open court - because the evidence would be sealed.
But in this case two different immigration judges held that the MS-13 connection was considered legally established based on the credibility and history of the confidential informant.
When I hear about this guy’s family I’m sad about the whole thing. Even people who do terrible things to others can love their own family. That doesn’t excuse what they do to others. I always hope that people can change, and wonder whether he was changing or whether he was just at a more comfortable stage of the game he’s been playing for a while.
I’ve read about the history, how the internal wars in Central America during the 1980’s caused people to flee to the US where the young people then created these gangs so they could feel like they belonged somewhere. Then they got deported back to their home countries where they then terrorized everybody. And spread all over the place.
Bukele has said that the gangs are satanic - that he heard from at least one former member who left the gang when they wanted him to sacrifice a child in allegiance to Satan. They require their members to purge themselves of their own consciences, so that they can kill without remorse or thought. But a human being without a conscience is worse than an animal, because even an animal has natural instinct that tells it how to behave. Once a conscience is dead, how can it ever be gotten back? Like a rabid animal that cannot be allowed to roam free, that person has to be contained. Probably until the day they die. And that is so incredibly sad. Such a waste of human life. But that’s what Satan does.
I hope that in all of this, the seriousness of what has been done to these people, that has led to so many innocent victims, is actually stared straight in the face. Satan doesn’t want it to, because he is trying (very successfully, I might add) to do to the whole society the very thing that has destroyed these gang member’s lives and souls: deaden our consciences so that we don’t even care what damage we do. We recognize no sanctity of human life. Survival of the fittest. That godless, lawless, animal existence is what these judges work so hard to defend and protect. Somehow we as a society need to tell them to literally go to Hell.

I’d like to see the El Salvador President say this judge - This is an El Salvadoran Citizen living in El Salvador, you have absolutely zero jurisdiction - and then call her a racist and colonialist, for interfering in Latin American affairs - which would shut her up.
That’s an excellent point. He fled El Salvador (why?) and was urged to seek “political asylum,” but who knows how many of their laws he broke as an MS-13 before leaving.
Choice of law issue and El Salvador may have original jurisdiction.
The same reasoning can be used with Venezuela’s criminals.
