California Proposes Restraining Orders to Stop Thieves
Mish Talk ^ | June 17, 2024 | Mike Shedlock

Background

In California, police don’t arrest criminals because prosecutors will just turn them loose. People and businesses are tired of the crime. The result is a campaign to roll back Soros-backed proposition 47 that made theft of less than $950 in goods a misdemeanor.

Stores are at the mercy of shoplifters and many merchants have decided to close up shop. Downtown San Francisco looks like a ghost town.

California Voter Revolt

The proposition 47 reversal has gathered enough signatures that it will be on the ballot.

However, the Progressive nut cases running the state propose an alternate measure with a laughable poison pill aimed at stopping the rollback.

Democrats Alternative Solution

Democrats are advancing a package of bills to assuage public anger about surging crime. One would let courts issue restraining orders against thieves, as if this would stop them. Another would toughen penalties for organized criminals who steal more than $50,000 in goods.

More than $50,000 you get TWO restraining orders and it goes on your permanent record.

Would solve a lot of problems.

To quote an early quote from a different thread:

Are there no voting-age people left in SF who still have at least one neuron firing? Look at what the mayors and governor of the state have done, yet you continue to vote idiots like this into office. You got what you voted for.

Restraining orders exist to keep people safe. They can provide a level of security if you’re afraid someone may hurt you. But before a court restricts your abuser’s freedom, it will require you to prove the allegations of your careful and thorough petition with evidence.

If you need a restraining order, you’ve come to the right place. If you haven’t already, read our blog on the basics of restraining orders, which discusses what restraining orders are and the process for getting one. Here, we discuss in more detail what you need to prove and the evidence you’ll need to gather in order to win your case.

What Do You Need to Show to Get a Restraining Order?
The specific elements you need to prove to get a restraining order vary from state to state, but in general, you need to show:

A specific instance or instances of abuse or harassment (such as sexual assault by an intimate partner)
The threat of further abusive behavior or harassment
In some states, you must also establish that:

You are in a qualifying relationship with your respondent (e.g., current or former intimate partner, etc.)
You are reasonably in fear of imminent physical violence.
When preparing your petition, you need to be careful. You need to allege specific facts. For example, instead of alleging that “he abused me repeatedly,” you should state, “on such and such date, at such and such a place, in front of so and so witnesses, he struck me across the face and threatened to kill me.” Something with that level of detail.

You also need to be comprehensive. If you don’t include a specific allegation in your petition, a court likely won’t consider it at your order hearing.

This may sound complicated, but it’s not that bad. Most courts have a form you can fill out.

If democrats keep getting 'elected' this is what the United States will look like in the future...

And that compulsive liar, President Sniffer? He's bragging about crime going down. Cops in blue hellholes don't arrest criminals - and blue cities don't report crimes to the FBI... and that old pervert Biden is bragging about it.

And the corrupt MSM isn't reporting this... for reasons we all know...all too well.

I read a long article by a SF resident - one who mentioned seeing a drug addict lying naked on the ground eating cardboard and what to do about it - IF ANYTHING.

What I got from her article is the worst, most despicable, thing to do would be to elect a Republican. Better to elect a compassionate rat who claims he will help (but of course does not). Then at least the voter can feel that she tried to be decent and oh well if the guy is still eating cardboard.

I had to wonder how she’d feel if that was her son lying on the ground...probably a whole different attitude.

Not sure about that. They can be awfully stupid with their own children as well.

How about slapping them on the wrist with an axe. I know it’s not popular and it’s been done before, but it is effective and reduces recidivism.
