Reading the title, I think the AP is saying it’s illegal for the GOP to talk about illegals voting. At least that’s what they want it to be.

The progression:
Step 1: That is a conspiracy theory. You are crazy for thinking it.

(c)(3) Subsection (a) does not apply to an alien if the alien “reasonably” believed at the time of voting in violation of such subsection (a) that he or she was a citizen of the United States

It is a violation of federal statutes for noncitizens to vote for federal offices and Congress has the power to easily enforce that law at the January Joint Session following each presidential election.

Not “even though” it’s illegal. “BECAUSE” it’s illegal.
That is the right of the State, but the Congress has the means at its Joint Session to not accept the results of any unlawful election to federal offices.
So long as such states make no effort to reasonably prohibit those noncitizen voters from voting for federal office the Congress can reject out of hand the results of any election.

If one carefully reads the entire statute, § 611 does not allow noncitizens to vote; there is no ambiguity, no loophole.
One can’t prove it because one is denied access to records, like immigration lists, green card holders, jury excusals, etc., but illegal aliens (and legal aliens) vote in large numbers.
In a decade, Virginia changed from solid red in 2004 to permanent blue by 2014 because of alien voting.
In Northern Virginia, where like Philadelphia, Chicago, Atlanta, LA, NYC, the democrats are in total control and run the registrars’ offices, the huge populations of illegal aliens and green card non-citizens have been registered by democrat operatives and their allies, like the SEIU.
And they vote more often by absentee or harvested balloting or mail in or early voting where they will never be confronted by poll watchers. Often, democrat operatives will do the voting for them and put the ballots in drop boxes.
Fraud is minimal on Election Day or in recounts, because the fraud takes place during the registration process. Once you are registered, you are home free. You can be illegal or green card or voting elsewhere or dead and no one will ever question it.

That is why fraud cannot be effectively corrected on a vote-by-vote or individual voter basis.
The Congress has to realize and declare whether a state's entire election process, including its registration of voters, was in violation of federal laws. If so, the entire results of such an election must be ignored; and the time for that is at the JS.
This January 2025 will be a reality check for our congressmen and our nation - it will be quite easy to declare whether a U.S. federal election was lawful or not.
