Author’s Note: In light of the Supreme Court’s disastrous and unconstitutional decision to support the Biden regime’s border invasion in the Texas “razor wire” case, it seemed to be the right time to revisit this article from 2021 which explained to conservative voters how our “hand-picked” conservative judges betrayed us during the post-Trump years.

It seems a hundred years have passed since President Trump picked Brett Kavanaugh and Neil Gorsuch and Amy Coney Barrett to serve on the Supreme Court and started what was supposed to be the Great Conservative Years of the Trump Era. Long after the Donald left office, there was going to be a “young gun” block of Textualists and Originalists making the liberals cry in decision after decision, and even rolling back Roe v. Wade eventually.

Finally, we owned the courts.

How wrong we were.

It wasn’t Trump’s fault. He had done his part and turned over the process of selection to the conservative legal movement — and the Federalist Society in particular. Leonard Leo, and the other law nerds, were trusted to locate a reasonable facsimile of Antonin Scalia, or two, for the new president. This was exactly what Trump was always being blamed for not doing: relying on the experts.

We wanted a short list of his judges, and Trump gave us one. And we were all happy.

Nobody among the conservative establishment wondered if the Federalist Society knew what it was doing. Was Gorsuch actually a libertarian with a soft soft for transgender employment discrimination cases and native Indian property rights? Would he, for instance, suddenly rule that half of Oklahoma was actually a Creek Indian reservation? Would he decide that the term “sex” found in legislation passed in 1964 actually covered sexual orientation and gender identity — ......

Emerald makes a lot of good points. How IS it that we are supposed to have a conservative majority on the Court, but when push comes to shove just enough so-called conservative justices twist the Constituion to find a way to give the liberals a win. Bruen is the only win for conservatives lately, but that win is only a heart attack and a stroke away from being reversed at a later date.

They reversed Roe v Wade. That was an earthquake in legal terms. It was the #1 issue behind all SC appointment angst for 40+ years. It was THE conservative issue.

That was the end goal of Federalist Society policy all this time.

It was a massive victory.

How soon we forget.

Almost every political organization sooner or later becomes “established” and then it’s just a matter of time before the tyranny of the status quo and the Left begins to take over.

Freedom is an ongoing fight against the “establishment” forces that array against freedom.

A small-government, libertarian lawyer and youtube/twitter/rumble podcaster named Robert Barnes has been saying this for years.

His accusation is that the Federalist Society are playing the role of “conservative” for the deep-state Uniparty.

I have wondered if the rogue CIA and FBI could have compromised some of the judges. There was talk that J. Edgar Hoover did this on more than one occasion.

The average and liberal judges in 2024 are a lot more liberal than they were 20 years ago. Same applies to law school graduates.

People also forget that being a textualist like Barrett and Gorsuch doesn’t necessarily mean they will always decide issues in the way conservatives would like.

Textualism is a method of statutory interpretation that asserts that a statute should be interpreted according to its plain meaning and not according to the intent of the legislature, the statutory purpose, or the legislative history. Justice Scalia was probably the foremost textualist of our time.

If you want a Supreme Court that tries to infer purpose or applies historical context, then you’d better be prepared for decisions that go both ways.

shouldn’t be news to anybody that the UniParty/Deep state owns most of DC;

They will do ANYTHING to keep the States from showing any independence from Fed.gov.

Yet that trend cannot be stopped....

Numerous conservative rulings over the years - more so than before - and one ruling, albeit it is very bad, we get something like this basically declaring all was for naught like nothing else every happened.

Typical nonsense from this writer. They want to perpetually lose and discourage people from participating so they can just always complain and create conspiracy theories.

Reversing Roe v Wade was part of the Get Trump movement. The tell is when mere months after the ruling Linsey Graham introduces a bill in the Senate to make all abortion a crime. A federal law that had no chance of passing. Why?
