Fani Willis’s Affair: There Are ReceiptsThe likelihood of recusal just increased.

The explosive allegations that could possibly sink Fulton County’s RICO case against Donald Trump, et al. – that she is having an ongoing affair with Nathan Wade, the Special Prosecutor she appointed to persecute Trump – have now been corroborated.

On January 8, attorneys for defendant Michael Roman (who faces various charges for challenging the 2020 election) filed this motion, alleging (in part) that Willis and Wade must be disqualified from the case due to ethical violations and prosecutorial abuses due to their affair. Specifically, the attorneys for Roman alleged that DA Willis and Wade:

“have traveled personally together to such places as Napa Valley, Florida, and the Caribbean and the special prosecutor has purchased tickets for both of them to travel on both the Norwegian and Royal Caribbean cruise lines.”

Those were serious allegations. And they were very specific as to the locations they traveled and Wade’s purchase of the tickets. It’s one thing to hear gossip from the Fulton County DA’s office… but how could Roman’s attorneys know all the particulars?

Because there are receipts.

They all come from Wade’s Cobb County divorce proceedings with his soon to be ex-wife, Joycelyn Wade. Joycelyn has sought to depose Willis as part of the divorce case, alleging that Willis has an ongoing affair with her husband and that Willis would have insight into Nathan Wade’s actions and the marriage itself – knowledge that would help the divorce court divide the marital assets and calculate spousal support. Willis sought a protective order to prevent her deposition and gave implied threats that Joycelyn was obstructing the DA’s investigation of Trump. Yet Willis never denied the affair.

And so attorneys for Joycelyn Wade dropped today’s bomb, which included her husband’s credit card statements where trips were purchased for Willis. You can read it here.

Special Prosecutor Nathan Wade has, according to his credit card statements, taken trips to San Francisco and Napa Valley, Florida, gone on a Caribbean cruise, Australia, Panama, and Belize. These trips all took place after he filed for divorce. And Willis – the boss of Nathan Wade, the woman who enriched him by appointing him as Special Prosecutor – joined Wade some of (if not all) of these trips.

These two are really stupid. Yet, they are getting paid a lot of taxpayer dollars and are responsible for the fate of our nation. Maybe we are the stupid ones.

Here is the problem, there is no crime here. Even the lenders that loaned Trump money say there is no crime here.

Lenders are required to do their own due diligence prior to lending Trump or anyone money. They don't just use any ole numbers Trumps army of lawyers hand over.

There is even a document enclosed in every one of Trumps loan requests stating that the lenders need to do their own analysis of the properties worth and use their own numbers.

So Willis spending taxpayer money to take vacations with someone else’s husband who was hire by Willis at a very special pay rate is saying because the wife of husband filed for divorce and provided receipts proving the affair is somehow obstructing the DA’s investigation……. 🤔….. 🤣🤣🤣🤣🤣🤣🤣🤣🤣

Willis just gives new meaning to the old saying, “if the law is on your side, argue the law. If the law is not on your side, then pound the table” or in this case someone else’s husband…. 🤣🤣🤣🤣🤣🤣🤣

Why would this be good for Trump if she is forced to recuse?

1. The political optics of having one or both of these people prosecuted for fraud while the Georgia case against Trump is proceeding would be delightful.

2. The bigger story here isn't the relationship between these two mutants. What hasn't gotten much attention is that the "receipts" mentioned here include evidence that the prosecutor/boyfriend was paid to meet with White House lawyers and House J6 committee members. There is absolutely no legal basis for this as a prosecutor in a state case. Those people are now potential witnesses in the Georgia case against Trump.

As an Attorney I can assure you this is not just unethical, it is illegal. The actual legal term for what they did is called “Theft of Honest Services”. The larger liability they face is that for each case she brought against someone that Wade was paid for is another count. It could easily be charged as a RICO case. The systematic charging of crimes by the DA and the subsequent payments to Wade for working on those cases provided illegal benefits to them both. Hence the term, Theft of Honest Services. In essence it is illegal to charge someone with a crime so you or a boyfriend, spouse or relative, etc.. benefit from those charges in any way that would constitute a thing of value, monetarily or otherwise of value.

Most prosecutions for "honest services fraud" that I've seen in the last few years were completely idiotic and should have been thrown out of court.

1. The fake Russian "election interference" cases prosecuted by Robert Muller's team involved charges of honest services fraud. That's the first time I ever heard of that kind of "crime."

2. Those Hollywood parents who were prosecuted in Federal court for submitting false/embellished college applications for their kids were also charged with this crime.

Both of these applications of the Federal statute regarding "honest services fraud" were idiotic.

"Honest services fraud" is a crime that's really designed for cases where a public official acted against the public's interest but didn't directly defraud the public out of any money. A zoning board member who serves in a volunteer capacity and accepts a bribe from a real estate developer, for example, would be a classic application of this law.

The good news is that Fati Willis and her prosecutor pet could potentially be prosecuted for this. They are public officials (as opposed to private citizens), they have a legal responsibility to act in the public interest, and they have spent a lot of taxpayer money in the process.

See my Post #33. My understanding is that the case as you described it would involve outright theft of money from the public -- whereas "theft of honest services" would only apply in cases where a public official acted against the public's interest but wasn't actually enriched in the process (at least not by the taxpayers).

“Honest services fraud is a federal crime, and it carries stiff penalties.”

And apparently they traveled to, or through, Florida while they were conspiring to deny Donald Trump his civil rights.

Florida has laws against conspiracies to deny people their civil rights.

No one is above the law; there is no place in America for those who conspire to violate the civil rights of another; and all that.

Florida needs to prosecute these conspirators to the full extent of the law.

Why would this be good for Trump if she is forced to recuse?

Two reasons.

1) A independent special prosecutor may have to be appointed and any truly independent lawyer would probably decide the charges are bogus and don’t want to pursue.

2) If anyone else is appointed, it will take time to be appointed and get up to speed which will delay the trial until after the election.
