According to News 4 New York, the former Marine, who was captured on video holding Jordan Neely in a chokehold on an F train in Manhattan, resulting in Neely’s death, is expected to surrender and face charges as early as Friday.
The Manhattan District Attorney’s Office has reportedly made the decision to file charges, which was not presented to a grand jury.
As of now, there has been no information released on the specific charges that will be filed.
Penny’s legal team had previously stated that he could “not have anticipated” that his actions to subdue an alleged threat would result in death.

He more than likely applied the same rules for restraining an individual, and performing a choke hold on a civilian, that the U.S. government taught him in the Marines.
Similar happened in Omaha during the BLM riots a couple years ago. The former Marine was not initially charged, then they had a special investigation, and he was going to be charged.
Sadly, he fled the area and committed suicide.

a) Not too many kids I knew were actually schooled in how to apply a proper choke hold. I also recall lots of my fellow kids trying to put people in a “sleeper hold”, yet nobody ever actually passed out from one.
b) Kids don’t have the same strength as an adult man, so any potentially lethal hold applied by a child is a whole lot less potentially lethal than one applied by an adult man.

It is probably appropriate to charge him and let his words decide. It would be especially appropriate if this court was outside of New York City, such as in Malone, Fort Drum, or Plattsburg.
Allow the subway riders to be the jurors.

If you PUSH someone, they might fall, hit their head...and die. So what? Sometimes you might need to push someone to prevent that person from harming others. Their problem. Not yours.

In corrupt, violent American cities, that’s EXACTLY what to do. Unless the vagrant attacks you or yours directly, let ‘em go. Step back and clear the way because criminals are a protected class in cities. It’s not worth having your freedom lost and your being made a target look after your own space and screw the rest.
I wonder if you realize how disgusting you are. This man stepped forward when others were being threatened. He’s not a cop, he has no formal orders, he just wanted to help others instead of standing around when someone got shoved onto the track.
