A former data science manager at Twitter is planning to sue Elon Musk for firing her while six months pregnant. As Musk began slashing jobs last week, Shennan Lu was one of many workers who were laid off. She subsequently took to Twitter to blast the Elon Musk-led company’s handling of the situation.
Musk will definitely NOT see her in court. EVER.
For spite he could have his lawyers drag their feet until the baby were in Elementary School.
Not unless Musk comes out and says, "Oh yeah, we targeted all the pregnant women."
Which, to be frank, Bezos probably did at Amazon.
What exactly is her claim? Does she want Twitter to pay for her late term abortion?
We can fire you for any reason.... It is way smarter to never provide a reason. They should say: We can fire you for any reason, or no reason.
And the employees are pissed that their gravy train is coming to an end.
Now they’ll have to find a job where they actually have to work for a living and probably for less pay, to boot.

Not so fast.
The Pregnancy Discrimination Act did indeed put preggers in the protected class. See the section on Young v. United Parcel Service for its current-day status.
Frankly, it's only because SCOTUS has trended conservative this century that the PDA hasn't been grossly expanded to cover this woman's layoff. Young was only 6-3 from a conservative majority, and put up a fairly easy test to overcome IF the woman can prove she wasn't accommodated.
This goofy broad at Twitter is shit-out-of-luck in that regard since Twitter was a goofy playhouse loft where anyone could do anything but work.
Twitter appears to be exceeding both Warn Act and California requirements.
What we don’t know if whether or not Twitter has any established policy (including, for example, “bumping rights”) which Twitter may be violating in this case. I doubt they do, and if that is so this is simply a case of a redundancy lay off for economic reasons and the lady has no case.

Are they “laid off” with potential for resuming work at Twitter at some point in the near future, say, within a year?
Or are they being flat out fired/terminated, for good, no backsies and the term “laid off” is simply being used as a euphemism to take the sting out.
Suing someone who has billions of dollars in eff-you money is a very bad idea.
There must have been non-majority, non-male, “handicapable” employees hired in their thousands to do nothing but make Twitter look progressive, and innoculate it against discrimination lawsuits
England has a notice requirement and he is giving them some notice but he has royally screwed this firing up. Now he is saying oops..we need some of you back.

If its for no reason then they have to pay an unemployment claim which is\was 40% of the weekly average of your last however many weeks wages.
If its for cause then you get jack.
The fact that they are talking to a pregnant woman means she is going to sue because she is in a protected class. She’s gotten bad legal advice. Protected classes are not protected when 50% of the company is being let go.
I was a university employee back in the 90’s when financial budgets were tight. I attended an all hands meeting discussing this. One of the better known and tenured professors actually said fire everybody and rehire them if we need them..
He’s not laying you off because you are PG, put some ice on it! In fact you have just been notified of the layoffs and will be fully paid until 2/2/23 at which time you the severance package will be discussed. So put a MASSIVE BLOCK of ice on it!
