The 8th Circuit US Appeals Court blocked Joe Biden’s student loan forgiveness program on Friday afternoon.

The court granted an emergency stay barring the discharge of any student debt until the court decides on a request for a longer-term injunction.

Reuters reported:

A U.S. appeals court on Friday temporarily blocked President Joe Biden’s plan to cancel billions of dollars in college student debt, one day after a judge dismissed a Republican-led lawsuit by six states challenging the loan-forgiveness program.

The 8th U.S. Circuit Court of Appeals granted an emergency stay barring the discharge of any student debt under the program until the court rules on the states’ request for a longer-term injunction while Thursday’s decision against them is appealed.

The St. Louis-based appeals court also ordered an expedited briefing schedule on the matter

“Agreed. The knee jerk attacks on this forum on anyone who doesn’t do what we want is as juvenile as the left’s identical orientation”

Not much different than the left many times.Too much reactive venting. Most of us (including me) should take a refresher class in civics and the Constitution .

I suspect the courts view this as a question of equity. For fairness sake, instead of only student loans all loans for everything must be forgiven, especially my mortgage loan.

Nobody is forced to take out a loan for college. Buyer beware. My son just took out a $5500 college loan and there are disclosures and warnings and payment estimates over time all over the place. Yes a loan needs to be REPAID and yes with interest. And no student loans are not “mandatory” (although unfortunately since college tuition at even in-state schools is $10-$15/year plus $15K/year for room and board now about 80% of college graduates do end up with college debt).

The more federal student loans available, the more colleges raise tuition.

There are solutions. Community college first, for example, and living at home for the 1st two years.

In this case though, once the loan was forgiven, the odds it would be reversed is close to zero, hence why coney was off her rocker to not issue the injunction

I think the courts are looking at this as a violation of the new “major questions” doctrine that emerged last year when the SC ruled that the CDC can’t tell landlords they can’t collect rent because of Covid, etc. And the EPA case.

When it comes to “issues of great political or financial importance,” Congress and the Administrative Procedures Act need to be involved/followed, respectively.

Biden wants to spend $1 Trillion on student loan relief and restructuring WITHOUT CONGRESS, just by invoking a pandemic “emergency” that’s obviously not an emergency and that’s now in the past.

My daughter lived at home and commuted to local state university… we had a small investment account we opened for her in 7th grade. It generated enough to pay tuition. She worked at a restaurant in Downtown Disney 25 to 30 hours a week to cover her other expenses….She graduated with no debt.

I think he used some old provision relating to national disasters.

So what happens when Joe (or whomever) decides to ignore the ruling and forgives debts anyway?

lawlessness

IOW:      what happens when RINOs abandon the Constitution and let their friends (marxists) run wild.

Yes, we should, I fully agree.

Yesterday, on a thread about how Amy Coney Barrett denied the emergency stay, someone put up a picture which morphed Amy Coney Barrett and Ruth Bader Ginsburg, and titled it “Any Coney Ginsburg”.

It’s depressing to think, that someone on this forum, thinks that there is no difference between Amy Coney Barrett and Ruth Bader Ginsburg. Because of a singular procedural ruling, someone among us thinks Amy Coney Barrett is just the same as having Ruth Bader Ginsburg back on the Court.

Think on that, and think of the mindset of someone who thinks that way.

“So what happens when Joe (or whomever) decides to ignore the ruling and forgives debts anyway?”

That’s exactly what corrupt Joe plans on doing. Starting immediately. Who will stop him? It will be a done deal, the money will have been sent out to students, and then what will the Courts do, as he will ignore their edicts. There is no rule of law in this Country anymore.

The Constitution is something to be ignored, done away with, worked around. We are governed by Marxists. If we don’t overwhelmingly win in this mid-term election, we are goners. VOTE.

P.S.: “the money will have been sent out to students” means in new loans to students in huge dollar amounts to further hook them on gov’t largesse, until they have to pay them off, and then Uncle Sugar Biden will forgive their loans also if we don’t win back our gov’t in these mid-term elections.
