OpEd: What Does Justice Ketanji Brown Jackson change?

Long-term Progressive Justice Stephen Breyer announced he would be resigning at the end of the 2021/22 term. President Biden nominated Judge Ketanji Brown Jackson to replace him. Jackson’s nomination was confirmed in the Senate.

Justice Breyer announced his retirement date as Thursday, 29 June 2022.

In the next Supreme Court term, Justice Jackson will be on the Supreme Court.

Little will change in terms of the policy on the Second Amendment.

This correspondent does not expect Justice Jackson to vary from Justice Breyer’s extreme hostility to the Second Amendment.

According to Justice Breyer, the Second Amendment was never meant to apply to individuals. If it applied to individuals, it did not have any force of law a state government was obligated to respect.

The Heller, McDonald, and now Bruen decisions reject that ahistorical analysis. The Breyer analysis can only be reached by an extremely selective view of the evidence.

The Bruen opinion by Justice Thomas lays out the evidence in a clear and convincing manner.

The Progressive philosophical basis has always been the Constitution is an impediment to the formation of government policy. It must be neutered or ways must be found to “work around” the “problem” of Constitutional limitations of government power.  Such “need” is exactly how the nation came to have the Roe v. Wade decision.

The Constitution limited the Federal government’s power to make abortion legal across the nation. In our government of checks and balances, such power was left to the states.

The Second Amendment presents exactly the opposite. The government was forbidden from infringing on the right of the people to keep and bear arms. The  Fourteenth Amendment made clear both the Federal and State governments were so forbidden.

In the Progressive philosophy, limitations on government power are evil. They prevent the government from doing all the things

Dedicated Leftists detest any limits on government power. The concept is core to Progressive ideology.

It is regrettable but it is not a shift in the court.

If (Big IF) woman is undefinable then whatever it is seated on SC doesn’t know what it is ? This is too complicated by design ? Is sad ignorance is defined as intelligence. The new intelligent is complete ignorance

Nothing changes except the one liberal judge is replaced by another, less qualified, but younger liberal judge. I can’t wait to read some excerpts from her opinions...

The is forever a BLACK Liberal female seat on the Supreme Court. No non-black of certain gender may ever be allowed to fill the vacancy in that day far up in the future, when KBJ leaves the court.

The only thing that changes with Jackson’s addition to the court is there are now three really stupid Commie females on the court. The contrast to other justices will be even greater. Jackson needs to be constantly abused and ridiculed. She is so stupid she can’t even define ‘woman’. Her appointment and confirmation is a gift. We can use it against Democrats and RINOs. I am certain that she lacks the intellect and ability to sway the opinions of the majority conservative justices.

Breyer, despite everything else, was occasionally a positive vote on religious liberty issues - such as Masterpiece Cakes case. Kagan as well. These cases will probably go from 8-1 to 7-2.

She changes pretty much nothing - she will vote the way Justice Breyer did in every case. That’s the thing with left-wing judges - consistency and lock-step ideological rigidity. It’s the “conservative” judges who delight in betraying conservative legal principles.
