Judges ruled on Tuesday that bumble bees can be classed as fish under California environmental laws.
This unlocks protections for the state's four endangered bumble bee species.
The ruling clarifies the state's confusing classification in its environmental protections.
A trio of judges in California said on Tuesday that bees can be legally classed as a type of fish as part of a ruling that brings added conservation protections for the endangered species.
"The issue presented here is whether the bumble bee, a terrestrial invertebrate, falls within the definition of fish," the judges wrote in their ruling. And, they concluded, it does.
Formerly, the problem for bee-lovers — and lovers of all Californian terrestrial invertebrates — was down to the way protected animals have been classified in the state's laws.
Although four different bee species were classified as endangered in 2018, land invertebrates are not explicitly protected under the state's Endangered Species Act (CESA), which protects endangered "native species or subspecies of a bird, mammal, fish, amphibian, reptile, or plant."....
They also argued that land-based invertebrates have been protected under the category of "fish" under the statute in the past, such as in 1980 when the Trinity bristle snail was protected.
The judges described how California's legislature has wavered for years over whether or not to explicitly include invertebrates in the Act, presumably saving them the trouble of having to expand the definition of fish.

One would think they could add (or put it in the law in the first place) “or any other living organism” as a catch all. I wonder why they didn’t?

Reminds me of a speech that was written for FDR back during the New Deal. The writer included something like “These efforts will strengthen American businesses. But be well aware that the government has no ambitions of gaining control of industry.”
FDR replied to the speech writer “Leave out that last sentence.”

Beavers are fish in Quebec and certain other places, but that’s for the sake of eating them. I suspect that this extends to all places that once fell under the domain of Quebec, which would be most, if not all, of Canada, and possibly everything west of the Alleghenies that was never Spanish.
That line of reasoning comes from a certain sort of moral theology (deservedly) associated with the Jesuits.
The California Court is Jesuitical. Accurate and demeaning.
Reasonable judges, would have told the Legislature to fix the law as opposed to creating who new classifications of species.
But there is nothing reasonable of the legal system in California.

That was called the Ontogenic Law. "Ontogeny Recapitulates Phylogeny". The development of the embryo reflects the evolutionary pathways.
It was cool to say at parties, but biologists didn't take it seriously very long.

I swear they are screwing with us. Honey Bee’s could have their own legitimate bill. Why make them a fish? will my great grandchildren be taught bee’s are fish, Men are women, women are men, claiming settled science? Everyone in California should capture bees and return them to the sea until they change this stupidity. Of course use wasps and hornets, honey bees are good 🐝 They’re too stupid to tell the difference.
Now we have courts in California declaring bees are fish, something a kindergartner knows to be false.
