The article says he pushed the attacker out of the way in a prior lap because he was blocking the track. I am guessing that could be classified as battery but the cops really just did not want to do their job.

Yes, I think you do.
The reporting is awful, as always. The challenge, from the responding deputies’ point of view is that they had a misdemeanor that had occurred outside of their presence, and even this news piece says that the victim had previously made physical contact with the assailant, so it would sound a lot like “mutual combat” without the video evidence. But for a juvenile, the “arrest” would mostly be a cite-and-release to the parents, so the family’s lawyer’s description is a little melodramatic.
OTOH, presuming that the video evidence is new, there’s nothing stopping the family from filing a new report. No way the DA will file though in current year. Some people have license to do whatever they want without consequence.

Perp is black. They were making idle threats to keep BLM in check lest they descend on the town and make things tough for the cops.
The only charge I can think of is fomenting a race riot. Wouldn't stick though.

Just a guess - the local cops have already maxed-out their DOJ-allowed arrest quota for black men, and don’t want any more, lest they lose Fed.gov money or get involved in a civil-rights lawsuit from the DOJ

The Family of the attacked victim, should have gotten the cops name who threatened arrest. The officers name should be mentioned in the story. An important part of the who, what, why... of the story.
