The perp was standing on the track actively trying to block the victim who was leading the race by a comfortable margin at the time. The victim pushed him out of the way, presumably because the perp was not allowing him to pass. That is not assault.

The puncher appears to be a non-participant in the event occurring on the track. He was obstructing the event and has no business being there.
