White House Refuses to Rule out Joe Biden Pardon for Hunter Biden

The White House refused to rule out President Joe Biden issuing a presidential pardon for his son Hunter Biden or for his brother James Biden as federal investigations continue over their foreign business dealings.

“That’s not a hypothetical I’m going to entertain,” White House communications director Kate Bedingfield said during the daily press briefing when asked about a potential pardon “I don’t have anything to add from this podium.”

Bedingfield was reluctant to address any aspect of the Hunter Biden story, after CNN, The Washington Post, and the New York Times recently published stories about the federal tax probe into Hunter Biden and his foreign business deals.

When asked additional questions about Hunter Biden and the president’s brother James Biden, Bedingfield would only reply, “I don’t have anything further to add from this podium.”

Pardon might be the only way out for both father and son.

Assuming a righteous prosecution (look, this is a hypothetical analysis so play along) of Hunter Biden, they have the goods on him for so many crimes that he would certainly have to do time and it could spell impeachment, if not conviction impeachment and removal from office for Brandon.

There is limited downside for Joe Biden for pardoning his son. Joe is a one term president and he knows it. He has nothing to fear from poll numbers, they are already beyond recovery. He can plead for mercy as a man who has sustained a loss of wife and child confident that he can exploit those losses to justify pardoning his only remaining son just as smoothly as he is done in the past.

The limited downside, because there are so many crimes Hunter requires a plenary pardon and that means that he is open to testifying against his father and uncles after he is vested in such a pardon because there is no possibility of self-incrimination. If he is required to testify, Hunter has to be wary of perjury on the one hand or implicating his father and brothers on the other hand.

Hunter's perjury would be easy to prove in view of all the facts laid out in the laptop, in his emails, and travel records, in his tax returns and in the testimony of people like Bobulinski. So perjury is a distinct trap for Hunter and, therefore, a threat to Brandon.

A specific or serial pardon might be considered but that would have to embrace all of Hunter's potential crimes and that might be too difficult to pre-determine. In any event, the prosecution might offer him immunity in an effort to require his testimony which would put the Brandon family back in its original position without the benefit of a pardon for Hunter.

Pardon is the logical way for Brandon to proceed especially if he keeps in mind the history of Richard Nixon who in his turn was pardoned - for the good of the country- and Brandon might well expect such a favor in his turn. Throw in a pardon for the uncles and the family enjoys a clean getaway.

One minor question, though:

Has it already been legally established (prior to this) that a pardoned person cannot avail himself of the Fifth Amendment? Is there really precedence for this? (At least insofar as the matter at hand concerned the acts for which he had been pardoned?)

Would, in other words, being pardoned be functionally equivalent to having been granted immunity against prosecution?

Wouldn't any sane Prosecutor immediately grant an UN-pardoned Hunter immunity anyway, since there are "bigger fish to fry?"

I have not actually researched the case law of loss of privilege against self-incrimination due to a pardon having been granted but I understand that to be the general consensus.

Yes, it is the functional equivalent of a grant of immunity against prosecution. I note that a federal prosecutor cannot grant immunity for state crimes; it appears that Hunter might well have committed both sorts of crimes. The grant of immunity, even if done in concert by state and federal prosecutors, unlike the scope of a presidential pardon, would have to cover every conceivable crime.

I think I noted this in a previous reply a few days ago. By the time all this gets sorted out, Brandon will be about a century old and perhaps long pardoned by his successor in office.

The case of Burdick v. US, 1915, indicates that the pardoned does lose 5th Amendment protection concerning the crime pardoned for. It’s not without legal controversy, but seems pretty solid.

Problem is that today’s courts don’t feel bound by precedent and are willing to impose their political preferences.

A pardon would create new problems for President Biden (not counting the backlash). A pardon would remove the ability of Hunter to hide behind the 5th Amendment.

He could be placed under oath and forced to answer question honestly or face contempt of court charges.

The Democrats (and the Media) are owned by Hunter Biden. He knows too much about too many of them. They will try to find a way to keep him out of the courts.

Prior to my finding out about my husband's cheating, we were living in the lower flat, under an older couple (in their late 40's, early 50's), who owned the house. They had two sons in their early 20's who lived with them. I wish I could tell you how many nights I heard the couple fighting.

The husband would go out, and come back in the middle of the night drunk, and the wife would be up waiting, and then the arguments began. A neighbor who lived across the driveway in the house next door, was also a witness to these arguments, especially during the summer when the windows were open. The neighbor's bedroom window was right across from their dining room, where the arguments always took place. The sound carried, so it wasn't as if you could ignore it. Nobody had air conditioning back then, so you couldn't close your windows to block it out.

From the arguments she learned that the husband would go to a local bar and sit, and drink. She also told me they argued about a woman he was seeing on the side. She said the wife was drunk too by the time he got home. The fights would basically be about his not paying attention to her. She would start crying, and beg him to touch her. He would rebuff her, saying: "Leave me alone!!" The arguments would escalate, get very loud, and sometimes the sons, if they were home, would get involved. Then there would be shoving and pushing, and sometimes, loud crashes. These scenes were repeated regularly for the time we lived there. And of course we couldn't complain to them about the noise, because we didn't want to have to move. I did eventually move out when I discovered my husband's cheating, but that couple remained together in their miserable world until they both died in their 60's. The sons had moved out by then. It was actually the experience of having lived under those people, and seeing how unhappy they were, see the repeated pattern of their unhappiness, that made me realize in my own situation, that I would rather live alone, and be happy, than live with someone and be totally miserable.

Thanks. It's been 43 years. It didn't take long to get over being f*cked over. If you love yourself, trust yourself and God, and respect yourself, it's easy to move on. You realize your bad choices, refuse to repeat them, and refuse to compromise your values ever again. Been happily divorced for 43 years. If there is such a thing as self-actualization, I reached that stage many years ago.
