Remington Did not Settle Sandy Hook Lawsuit

Much of old Media are parroting headlines similar to these examples:

The problem with these headlines, as with much of the reporting on the old, dominant media, is they are all false.

Remington, the gunmaker, did not settle with anyone. Remington the gunmaker no longer exists. The people who settled with the families are not gunmakers. They are insurance companies. Remington had no say in the matter. If the case had gone to trial, Remington very likely would have prevailed. The lawsuit was always highly problematic.

From the National Shooting Sports Foundation:

Insurers for the defunct Remington Outdoor Company (ROC) reached a settlement for $73 million with families suing the gun manufacturer under Connecticut’s Unfair Trade Practices Act (CUPTA). The insurers reached the settlement since the company no longer exists after falling into bankruptcy. NSSF noted that no manufacturer admitted liability and the plaintiffs never produced evidence that advertising ever influenced Nancy Lanza, who legally purchased the rifle, nor her son who murdered her and committed the heinous crimes. The Connecticut Supreme Court wrote in its Soto v. Bushmaster (4-3) opinion, “[T]he plaintiffs allege that the defendants’ wrongful advertising magnified the lethality of the Sandy Hook massacre by inspiring Lanza or causing him to select a more efficiently deadly weapon for his attack. Proving such a causal link at trial may prove to be a Herculean task.” NSSF believes the Court incorrectly allowed this one claim to go forward

Remington did not exist when the settlement was made. It was a settlement, not a court award.

In otherwords the insurance company settled the case with cash. Lots of money in that insurance company if they can write that off.

Yes. The stockholders should fire the Insurance Company CEOs who made that decision.

Glenn Beck says those insurance company CEOs are all very "woke".

Maybe, but it is still a victory for the Left.

They drove an American legacy gun manufacturer into bankruptcy and now no longer manufacturers guns.

They could pick them off one by one this way.

Adam Lanza was a budding schizophrenic experiencing his first psychotic break. It explains why Lanza was not diagnosed with schizophrenia, only learning disabilities. Conversations between Lanza’s divorced parents imply that Adam’s mother was actively shielding Adam from a diagnosis of psychosis. Adam’s mother introduced him to firearms and the firing range to provide some focus to Adam’s nonsensical life. Adam Lanza did not legally or illegally purchase the Bushmaster he used. Adam stole the Bushmaster from his mother, and murdered her with it. Adam’s Mother had purchased the firearm legally. There are some life lessons to be learned here which don’t include blaming the firearm.

No. Remington was solvent and was bought by a larger corporation. The corporation, Cerberbus, then dumped all it's debt onto Remington.

That's what bankrupted Remington.

Similar tactic as to how Enron hid its debt.

More clarification:

The Remington of that lawsuit no longer exists, not since late 2020. Everything since late 2020 that they call Remington is simply the insurance company(s) that was left holding the bag. A pool of money was set aside during the second banryptcy for this and other ongoing legal cases against the former Remington Outdoor Company.

The families settle because they were never going to get any more money out of the law suit than what the insurance company offered since there was no company left to generate any more money.

The second bankruptcy deadended all lawsuits against the former Remington Outdoor Company from following any one particular brand to its new owner. ie Sandy Hook families cannot sue Franklin Armory the new owners of Bushmaster.

That quote came from a lengthy discussion of the subject from a popular gun forum known as "The High Road."

Not only did the Remington of that lawsuit no longer exist at the time the settlement was announced, all of the assets once owned by the former Remington already had been sold and ownership of same transferred to other entities.

Bushmaster — who was the manufacturer of the rifle the Sandy Hook mass murderer elected to steal for that purpose — already was producing firearms (to include Evil Black Rifles) under new ownership (Franklin Armory/Crotalus Holdings) when the settlement was made public.
