LETTER TO SENATOR MARC RUBIO, FLORIDA OPPOSING HIS SUPPORT OF AMENDMENT TO THE LACEY ACT

My letter to Senator Marco Rubio, Florida:

An amendment to House Resolution 5421, passed on party lines, and Senate bill S626 will amend the Lacy act to prohibit the transportation into or within the US of all live animals of all types.

Exceptions are: 1 - farm animals 2 - cats and dogs 3 - any animal that was traded in very large numbers during the calendar year 2021. It should be noted that the pandemic greatly reduced animal shipments during 2021.

Senator Rubio, you wrote this legislation and submitted it to the Committee on Environment and Public Works on March 9, 2021. Your legislation was added to HR5421 and is now approved by the House awaiting Senate approval.

This will destroy most of the pet industry. Only those most popular 50 species of fish sold by chain stores in vast quantities will be listed. It should be noted that the common Plecostomus is the most injurious and most popular fish in the industry. Clearly the bill is not about the protection of anything other than special interests.

This law, if passed will create a white list of approved species. ALL others will be banned. The result will be loss of income of indigenous people world wide and the loss of habitats hobbyists have been protecting for 75 years.

The unintended consequences of this foolish legislation will cause the extinction of thousands of species currently protected by the pet industry.

Mining, logging, and farming interests are anxious to purchase the land on which these species thrive. Once it is no longer of economic value for the animals living there it will be destroyed.

Senator Rubio, your efforts to approve this malicious legislation demonstrate your utter failure to understand the science of invasive species. Many of us are shocked and dismayed that you could pander to the extreme ideology that promulgates this kind of horror.

My neighbor has an African grey parrot imported from the wild about 40 years ago.

The bird is still wild and would bite your finger tips off if given the chance.

Check your definition of invasive. Invasive plant and animal species are destructive to native species. In other words nuisance.

Burmese pythons have decimated the native mammal population in the FL Everglades. Initially introduced into the Everglades by either accidental or intentional release of a "pet" python, thousands of the invasive species are removed annually. Other well known invasive species in and around Florida include the destructive Lionfish, the Giant African snail and the Cuban tree frog.

Plecostomus, "glass cleaner fish", the most popular after being flushed down the toilet...

I've caught several of these fish while bass fishing, over the years.

It is rare for an invasive species to become a problem. Most are benign. The majority do not survive.
I define invasive as any species that exists in a place where it did not exist before. It has invaded new territory.

Honey bees are invasive. They do not pose a threat to any existing populations. English sparrows are invasive. They do not pose a threat to any existing species.

The founders apparently wrote the Commerce Clause with a different meaning for the word “regulate.” That meaning was “to make regular by removing impediments.” They would be doing head-desks with our version of regulating commerce, which is an inversion of what they had in mind.

Right now our big ranch is being over run with Aoudad Sheep as is many parts of Texas, New Mexico, Arizona and Old México. They were imported back in the 40’s. They compete with the native Desert Bighorn sheep and native Mule deer. Axis deer are taking over central Texas competing with whitetails. Eurasian Dove are taking over much of the US in competition with native Mourning and Whitewing dove.

Your definition of invasive is mistaken for the correct term “non-native.”

Invasive: A plant or animal species that: 1) is non-native (or alien) to the ecosystem under consideration and, 2) whose introduction causes or is likely to cause economic or environmental harm or harm to human health.

Many beautiful indoor houseplants are wonderful specimens in the pot until ignorant or careless humans choose to plant them in the yard.

Because too many Yankees escape to Florida, planting their invasive houseplants outdoors and releasing their overgrown exotic pets into the environment.

Dont forget the insects that are destroying millions-billions of trees. Eff-in ppl and their need to outdo someone else with a “pet”, then get tired of it, and let it go. If possible, chip-em, and if released, ship these stupid ppl into jail!

The communist change the meaning of the interstate commerce clause. To include all commerce.

Where the original meaning was to stop states from imposing their own laws, taxes and tariffs on interstate commerce.

Not to give the federal government to have control of all aspects of commerce.

Just another bastardization of the constitution.
