Biden Defies Supreme Court, Expands Dictatorial Powers

Yesterday, ‘President’ Biden violated his oath of office when he announced that the CDC was extending its illegal moratorium on evictions for another two months. Thus, the “fundamental transformation” of the United States from a constitutional Republic to a lawless Dictatorship continues. Biden is knowingly acting in defiance to both the Supreme Court and his own legal advisers.

At the end of June, a majority of the justices on the Supreme Court agreed with a lower court decision that the CDC had exceeded its authority in imposing a moratorium on evictions and mortgage foreclosures. Despite this acknowledgement of the lawlessness of the CDC moratorium, Justice Brett Kavanaugh voted with the liberals on the court to leave the ban on evictions in place because of its pending expiration and “because those few weeks will allow additional and more orderly distribution of the congressionally appropriated rental assistance funds.”

But Kavenaugh also wrote in his separate concurrence:

“In my view, clear and specific congressional authorization (via new legislation) would be necessary for the CDC to extend the moratorium past July 31.”

Biden ignored this clear indication that the majority on the court agrees that the CDC moratorium was illegal and could not be extended, even on extra-legal pragmatic grounds, past July 31. Furthermore, Biden even acknowledged that he was disregarding the opinions of legal scholars who told him that this action would be unconstitutional.

“I’ve sought out constitutional scholars to determine, what is the best possibility that would come from executive action or the CDC’s judgment? What could they do that is most likely to pass muster, constitutionally? The bulk of the constitutional scholarship says it’s not likely to pass constitutional muster, number one [emphasis added]. But there are several key scholars who think that it may, and it’s worth the effort.”

In plain English, what Biden is saying that he is willing to take any action he wants if he thinks he can get away with it, even if he knows the action is unconstitutional. He didn’t even try to make an positive argument about how this action was constitutional. Instead, Biden is announcing that he is willing to act unlawfully and will seize as much power as possible. This is the action of tyrannical dictator, not that of a legitimate president sworn to uphold the rule of law and the constitution.

I probably should have articulated that. That’s precisely what I’m talking about.

EVERYONE should be getting a break on those, not just the folks that own rentals.

And since the majority of those taxes are school taxes, everyone should enjoy a break.

And with more and more homeschooling, happening around the country, is one of the reasons for all these illegal alien kids, so the schools and education system keeps the status quo?

THIS JUST IN:

CDC decrees no car payments until everyone is caught up on other bills!!! Driving a car is a right, you have a right to freedom of travel!

CDC is also considering mandating NO MONEY REQUIRED AT GROCERY STORES! No one should be forced to budget or eat low cost food or do without!

CDC now indicates they are considering banks pay all customers $10,000 per month interest until the economy recovers! “Feral Reserve” and “Treasury” both agree!!!

I guess Biden’s supporters at BlackRock will be picking up rental properties at distressed prices when landlords begin capitulating and filing for bankruptcy. Must be good being the crooked dealer at the poker game.

The Supreme punted the last case because the mandate was expiring.

I said for years the Democrats would eventually reach a point where even SCOTUS is ignored. Chief Wussbag Roberts are you content to be reamed a new one by the executive branch or are you going to act?

If the Democrats can ignore SCOTUS, ignore the law, ignore congress and ignore our votes then it’s time to surrender or engage against what they are forcing upon the rest of us, just like they did in 1861 when they ignored the laws of the land.

This author, and many posters on this thread appear ignorant of the fact that the USSC declined to overturn this assumed CDC authority in June of this year.

5-4, with Kavanaugh concurring.

Nobody is defying the Supreme Court.

That’s how badly Kavanaugh failed. Abject, criminal level stupidity.

While did not remove the stay on the lower court decision declaring the CDC lacked the authority to impose the moratorium, a majority of the justices did say that any extension beyond July 31 would need congressional authorization. I would say that issuing a new moratorium in the face of this is defying the court.

Talk to me when there is a moritorium on real estate

I do agree there, I can see the moratorium myself but I do feel in return, the landlords need a break too such as your suggestion above. If you are going to give the renters a break, the landlords deserve a break in return.

They should have done a Covid stimulus program that paid landlords directly on behalf of the renter, instead of giving the renters cash.

I’d rather see a moratorium on property taxes, more than anything else. But a small check to the landlords is something I could get behind.

Don’t know about you, but when I look at my property taxes, more than half is for schools I don’t use, never have and don’t intend to. School was out for a long time because of Fauci and his cohorts.

Since when do the Democrats play by any rules? They do what they want, when they want.

What enforcement mechanism does SCOTUS have? Does it have an enforcement element? Are they going to send a strongly worded letter to the White House?

Do you any of them, other than Alito and Thomas, give a sh*t?
