BREAKING: Devastating News for Fulton County Election Audit, Judge Rules in Favor of Election Workers’ Claim of ‘Sovereign Immunity’
Becker News ^ | June 24, 2021 | Kyle Becker

Judge Brian Amero has ruled in favor of Fulton County election workers in a devastating ruling that jeopardizes whether the county’s election audit can proceed. The legal determination was made on Thursday night.

“A judge dismissed most of a lawsuit Thursday seeking a deep inspection of Fulton County absentee ballots from last year’s presidential election, a review pursued by voters trying to find fraud,” the Atlanta-Journal Constitution reported.

“Superior Court Judge Brian Amero’s ruling jeopardizes the prospects for the ballot inspection to continue, though a plaintiff in the lawsuit said he believes it will soon move forward,” the report added.

The case brought by Garland Favorito hinges on ‘discovery’ to determine if Fulton County election workers, the defendants in the case, scanned absentee ballots multiple times through tabulators, as appeared to be the case with State Farm Arena’s CCTV video surveillance from election night. ... The lawyers also claimed sovereign immunity to keep the ballots from being subpoenaed for discovery. The judge obviously agreed and essentially ruled that the state cannot be compelled to show independent parties that ballots cast in an election were valid.

You are misreading. That is not what the Judge is finding.

The ballot inspection will continue.

This makes no sense to me. I'm not saying that the law has to make sense (although it should), but the judge has ruled that the ballots cannot be audited by "independent parties" Is that correct?
Does that mean it can only be "audited" by people with a vested interest in not revealing their errors (intentional, or otherwise)? That is absurd.
An audit only works if it is performed by independent parties. That is basic Quality Control.
Seems like we are in a bizzare-o world, and hopefully this decision will be quickly appealed and overturned.

How can ballots have sovereign immunity?

Here was Fulton County’s gambit: Dismiss the Fulton County Election Board on a sovereign immunity basis.

Granted.

Instead, the lawsuit will proceed against the Fulton County Election Board members in their individual capacities.

Motto: Be careful what you ask for.

Context: I am a business lawyer and set up corporations and LLCs for clients. This is the functional equivalent of “piercing the corporate veil” and holding business owners liable in their individual capacities, thereby putting their homes at risk.

What’s to stop the GA state Senate from ordering an audit like the AZ Senate did?

Is it legal, or should it be legal for a judge to hide the evidence of a crime? Can the judge be prosecuted?

Key Largo is great. I just watched the other day and took note of that same speech. Things haven’t changed.

We call it a democratic republic,

Not sure to whom you’re referring as “we,” but I and any self respecting American call it a representative republic

A judge does not have the discipline to put politics aside and rule with wisdom. It is fashionable now days, to rule the way you want to make policy.. if you are a dem, then rule for the dems..

Some justice!!!!

Not totally. The judge did allow the lawsuit to proceed against the board of elections members. However, he apparently ruled that the ballots can't be subpoenaed as evidence. So, they can use the videos of Ruby Freeman and company scanning the ballots multiple times as evidence, but they can't subpoena the ballots themselves to see how badly the real count is off. I would like to read the judge's opinion myself, but this is what is being reported.

Just what is this Becker news?

I assume it is more credible than CNN, and other corporate media. Let's see how accurate his report is.

Thomas Jefferson wasn't a self-respecting American?

Have you joined the PC crowd canceling Jefferson?

Pretty close...
The only good communist is a dead communist that doesn’t vote after they’re dead.

Democratic republic? Like North Korea (DPRK - Democratic Peoples Republic of Korea).

Wrong. A democratic republic is communism.

The USA is Constitutional Republic.

I took Russian in college, circa 1965. My professor was from Russia and would sometimes tell us about mother Russia. He told us his brother’s job was to enforce the Stalin doctrine, now renamed Stacy Abrams. His brother primarily changed the votes. Technology/Dominion was not as advanced in those days.
