ATLANTA — A judge on Thursday allowed a lawsuit alleging fraud in Georgia’s most populous county during the November election and seeking a review of absentee ballots to move forward. Originally filed in December, the lawsuit says there is evidence of fraudulent ballots and improper ballot counting in Fulton County. The county, county elections board and county courts clerk had filed motions to dismiss the lawsuit. They argued, among other things that the the lawsuit was barred by sovereign immunity, a principle that says state and local governments and can only be sued if they agree to it.
After holding a hearing on those motions Monday, Henry County Superior Court Chief Judge Brian Amero, who was specially appointed to preside over the case, agreed. He ruled that the constitutional claims against those three entities are barred by sovereign immunity and dismissed them. But he also granted a request by the petitioners to add the individual members of the county election board as respondents in the lawsuit instead.

Oh, those idiots.
They’d probably have been better off leaving themselves as it were on the original lawsuit.
This way they can be hit on the personal level with fines.
I mean, it’s great for those who filed the lawsuit. And I am thrilled the judge did what he did!!!

The judge ruled brilliantly and justly. He let the county have their sovereign claim so there can be no appeal in that direction. He lets the voters substitute individual names which is perfectly legal.
This ruling should be appeal-proof which is a beautiful result for voters.
We can’t sue a sovereign body but we can sue individuals inside the sovereign for neglect, dereliction; injury.

A brilliant straw man. The issue was never about suing the state of Georgia for money. The issue is ability of its citizens to see the ballots from the election, and use them as evidence that the process needs improvement in the future, or to hold those who rigged the election accountable. According to this judge, no one has a right to see them, even if their voting rights were blatantly violated. It's Nixonesque like a claim of executive privilege. In this case the people of Georgia are the sovereign, not the corrupt board of elections, and they have a right to see the ballots, use them as evidence in court, etc. They paid for them.
