Amazon slams Parler in court reply and invokes Big Tech's liability shield

Amazon Web Services filed its response to Parler's lawsuit on Tuesday, blaming the social media platform favored by the far-right for filing a "meritless claim" against the cloud computing giant and citing a liability shield often maligned by President Donald Trump: Section 230 of the Communications Act of 1934.

AWS's legal brief argues that it is Parler, not Amazon (AMZN), that breached the terms of its contract and that Parler's removal from AWS's hosting platform was a "last resort." "This case is about Parler's demonstrated unwillingness and inability to remove from the servers of Amazon Web Services ('AWS') content that threatens the public safety," Amazon wrote, "such as by inciting and planning the rape, torture, and assassination of named public officials and private citizens."

Rape, torture and assassination?! Jesus! I’d love to see the prove they have. I’ve NEVER met a right-of-center American who would espouse those things. That’s firmly in the playbook of the American left.

Then it will go to court and we’ll get to see what was supposedly posted and if Parler took it down. My bet is on Parler.

If true, you can use law-enforcement to go after individual perpetrators. How often do death threats (and other threats) occur on social media forums owned by Leftist, Big-tech giants?

I believe Section 230 is around making sure law enforcement is made aware—not unilaterally taking action.

This is the operative section of 230:

“(2)Civil liability

No provider or user of an interactive computer service shall be held liable on account of—

(A)any action voluntarily taken in good faith to restrict access to or availability of material that the provider or user considers to be obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable, whether or not such material is constitutionally protected; or

(B)any action taken to enable or make available to information content providers or others the technical means to restrict access to material described in paragraph (1).[1]”

The key phrase is any action “taken in good faith” to restrict ontent. Amazon is a partisan political organization, that is not acting in good faith. All Parler needs to do (assuming a fair trial) is demonstrate Amazon’s failure to crack down on other leftist sites that are filled with hate against President Trump and conservatives.I am not naive enough to expect that a hearing presided over by a Democrat judge will be fair, but the law is clear.

I wouldn’t be surprised if violent content was on Parler and escaped content moderation due to their volunteer “jury” system. Parler’s system was flawed and relied on the users to self-moderate.

That being said, Amazon are complete hypocrites in their standards to enforce their policies. They also host Twitter and Twitter has far more violent content and allowed “#HangPence” to trend.

Funny, I haven’t been using or looking at my Parler account during the election, but I’ve seen plenty of threats, intimidation, and calls for violence on Twitter during that time. Lin Wood’s “execute Pence” stuff was on Twitter nearly every day.

Interesting that no one is shutting down Twitter...

(well, not so interesting)
