Biden Security Clearance Vanity Question

Posted on 11/30/2020 3:41:40 PM PST by 12chachacha

In light of Joe Biden’s obvious conflicts of interest and shady dealings, how could one challenge his security clearance? If he were just Joe Citizen there is no way he would be granted a security clearance. We have a wealth of evidence implicating Joe and his family and friends.

It will just cost more than usual for the HarrisBiden security clearance, but our new President Xi will pay for it out of petty cash.

It’s been my experience that elected politicians and their staffers are somehow outside the security clearance process, for right or wrong. Just my observation.

If he is declared President, HE decides what is classified.

I know—it doesn’t seem to make sense. But that’s how it works.

If he becomes President he will have the ultimate say over his security clearance. Trump should revoke it if he has it. Trump should put a halt to the transition. Screw Biden in everyway possible.

Your observation is correct. If they’re voted into office they are vetted by definition. Character matters but most voters don’t care.

When Hillary was First Lady and Sec. of State, she was quite proud of the fact that she kept the security detail from questioning the people who worked for her. Especially Huma.

She did it by making sure her people had no time to do a sit down with the people conducting security clearances, and continually missing appointments.

So, I am not sure, but it is possible that most of the people working with secure documents in the Clinton and Obama administrations may not have completed their clearances. And, that may be one reason why Hillary was so lax about handling top secret documents - she may not have been to any of the instruction sessions about how to handle top secret stuff.

Like another poster said about Bammy and crew, it somehow don’t matter with politicians.

I did hear some postualtuons back then, that if a person gets elected, then they automatically pass all clearances through the ‘will of the people.’

All smoke and mirrors I’m sure. Another example of royalty vs the peasants. People governing the government is over. And this election farce is prime example.

So what. It’s what Harris does that will matter. Joe won’t be with us very long.

The security clearance level goes only as high as a need to know basis. The president doesn’t need to know everything as he does not directly supervise everything. All he needs to know is results, not how unless it falls under certain scenarios like initiating combat, use or protection of sensitive federal property, or the use of NBC. There are a few others, but mostly he needs results not how they got that way. That’s the job of his staff going down the chain. The president doesn’t make every decision any more than the CEO of Burger King cooks.

If he’s sworn in he has it. He’s at the top of the executive pyramid. Any way he’s (and Kamala!) already have had the equivalent of the President’s daily Intel brief, before you get outraged that’s been standard procedure for Presidential candidates since Truman. Clearance process is an executive department matter. Biden or somebody equally alarming in a normal world will make those decisions. Character matters except to Rat voters.

The President does not require a security clearance. His authority to receive classified information is already vested in him by the constitution and by statute.

The President has the power, under 18. U.S.C. 798 and probably other statutes, to authorize people to receive classified information—it is only a crime to disclose classified information to a person who “is not authorized to receive” classified information “by the President.” Moreover, any law preventing an officer or department of the federal government from disclosing information to the President would almost certainly be an unconstitutional violation of separation of powers. Article II vests the entire “executive power” in the President and empowers him to “require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices.” The Supreme Court recently held that the Vesting Clause means that all executive officers are subject to the supervision and control of the President, in Seila Law LLC v. Consumer Financial Protection Bureau, in which SCOTUS held that the CFPB’s structural independence from the President under Dodd-Frank was unconstitutional.

But as head of the executive branch he has the legal Constitutional right to all the details should he\she choose to seek them. 9999/10000 Presidents don’t have the time or need to do that. They can delegate it to their staff (They’ll get whatever clearances, access, etc. they need by Prez order !) and there lies the danger.

Bush 43 with his DWI and alleged cocaine use in College, Clinton with his numerous affairs and drug use, Obama with his drug use, close association with terrorists and closeted “life style” ....even Trump with all the extra marital affairs etc., Bush 41 was probably the last POTUS that could actually have passed a security clearance. Pretty sad these guys are the best we can do. (Don’t get me wrong...love Trump policies..but realistically he would not be granted a security clearance).
