Pennsylvania Judge Patricia A. McCullough ruled that the Pennsylvania preliminary ELECTION CERTIFICATION injunction was PROPERLY ISSUED and should be upheld.

McCullough added this, “Additionally, petitioners appear to have established a likelihood to succeed.”

This is very interesting.

I have read the original Nov 9 complaint by the Trump Team

In the Nov 9 Trump Team complaint, they argue that the PA Secretary of State overstepped her bounds by illegally violating ACT 77 in the guidance given for the 2020 election.

Now, these new complaints argue that ACT 77 is unconstitutional because the Legislature violated the PA Constitution when they enacted ACT 77 in 2019.

Bravo to the lawyers who are digging into the procedural violations.

The Nov 9 Trump Team Complaint focused on procedural issues. Namely, their complaint pointed out the times that the PA Secretary of State issued guidelines for the Nov 2020 election that were contrary to the Act 77 law passed in 2019.

It is much easier to prove procedural violations that would invalidate an election than to prove fraud. How many people could you find who would admit to committing a crime?

Now, this latest complaint argued that the Act 77 law is unconstitutional.

I would think the remedy is this:
PA Legislature becomes the party to determine whether Trump or Biden electors go to the Electoral College.

PA does a revote on all other offices.

You are exactly right. And I am of the mind that the 3rd Circuit Opinion saying that following the law is optional was done of purpose so the case could go immediately to the US Supreme Court.

And I also am of the mind that Clarence Thomas has vivid memories of the past and would like nothing better than to join with his 4 other conservatives at SCOTUS and put Biden’s head on a pike for what Biden did to him in 1991.

Evidently PA congress gave up their power to choose electors via legislation. However they can’t usurp the constitution via anything but an amendment any more than the SOS/BOE/Governor can usurp them by changing how people vote.

PA is just a mess.

You obviously have read the complaints and the opinions and that is why you have such a clear understanding of what has happened and what has not happened.

I too have read the complaints and opinions and I totally agree with what you wrote.

The legislature doesn’t even require her help in doing that. There is so much going on right now: supposedly the legislature taking its own action on Monday, this ruling, and the Trump team reportedly looking to move up to the USSC.

I think it will only be the new ones in non-compliance with the law. Thus the mailed out vs returned. Most of the new ones are Dem.

You claimed the author misunderstood the judge who said it looked like the Trump campaign had a winning argument - was likely to succeed.
You also said the judge couldn’t give the legislature power it already didn’t have, but the judge didn’t try to do that.

Maybe we all need to donate some money to Crime Stoppers so that organization can increase the reward they will pay a person who gives them a tip about someone who fraudulently voted.
