Ted Cruz engaged in a heated exchange with Andrew McCabe about Gen. Flynn and the Logan Act, asking if Joe Biden had already violated it.
CRUZ: “OK. He is talking with foreign leaders and it doesn’t violate the Logan Act because the Logan Act is unconstitutional, which is why it’s never been used to prosecute anyone. You authorized using it to go after General Flynn as part of a political persecution. I can give you the answer, hell no Joe Biden is not violating the Logan Act. The reason you won’t say it, is because that was your flimsy political basis to go after a decorated war hero because you disagreed politically with President Trump.”
Yes. Next question.

Ted Cruz is a good Senator.
I’d have to read the Logan Act in detail (not gonna happen today, anyway) to see if I agreed with the claim it is unconstitutional. But the same standard should be applied to everyone, which is a far more important point.
A year ago would have been better.

Yes. He is. I leaned toward Cruz during the primaries last time around. But I’m glad we got Trump. Cruz has found his niche in the senate.

I have always liked Cruz, but two problems...
(1) Out of electoral necessity, he has always been squishy about immigration law.
(2) I do not think he can win a national presidential election.

Hell, YES, Biden IS violating the Logan Act!
Biden is already having policy phone calls with world leaders.
Biden is NOT president or even president-elect.
A common citizen cannot do business with foreign leaders.
He is also a heck of a litigator!
McCabe thinks he weaseled his way around a perjury charge but I'm not so sure about that.
