WATCH: @TimMurtaugh repeatedly corrects Fox News host @JulieBanderas on Pennsylvania election law.

The PA legislature said ballots must be RECEIVED by E-Day, not just postmarked. Democrats in PA extended it for 3 days, contrary to the law.

The public was on constructive notice of the lawsuit that ended up in the PA supreme court PRE-ELECTION and is now waiting to see if the USSC will grant a Writ of Cert.
Knowledge can be imputed to the voters that they had notice that the return deadline was at issue, and could invalidate their ballot if it was returned late, and yet some still ignored it.

To wit: the state supreme court ok’ed late-arriving votes. This seems a blatant affront to the U.S. Constitution. But, since was done, and not immediately struck down, it seems like the votes cast were good-faith.

Pennsylvania’s Act 77 of 2019 authorized mail in voting

It specifies in Section 7:

“(ii) An absentee ballot cast by any absentee elector as defined in section 1301(i), (j), (k), (l), (m) and (n), an absentee ballot under section 1302(a.3) or a mail-in ballot cast by a mail-in elector shall be canvassed in accordance with this subsection if the absentee ballot or mail-in ballot is received in the office of the county board of elections no later than eight o’clock P.M. on the day of the primary or election.”

And then we have
“Section 11. Sections 1, 2, 3, 3.2, 4, 5, 5.1, 6, 7, 8, 9 and 12 of this act are nonseverable. If any provision of this act or its application to any person or circumstance is held invalid, the remaining provisions or applications of this act are void. “

When the PA Supreme Court struck down the requirement of Section 7, it triggered the “nonseverability” clause.

My impression is that the US Supreme Court could rule that, when the PA Supreme Court struck down the deadline, it also struck down the authorization for mail-in ballots.

It remains to be seen as to whether the Supremes have the guts to say that.

I hope Supreme Court will throw out ballots received after deadlin, but the question I haven’t heard answered yet...did PA actually segregate the late arrivals? Alito belatedly ordered they do so but did they follow that order. If late arrivals have been comingled with legitimate ballots what is the remedy?

In my view, the Supreme Court rules that a new election be called, with a new time line, in time for the election to be certified prior to Jan. 21, SHOULD the election be not sooner determined by an audit of all ballots from which poll watchers were effectively denied, or should the Presidential race be determined, independently of Pennsylvania’s vote.

This would uphold the Constitutional requirement that state legislatures determine the process; and still allow two out cards.

Not asking you...just picked your post to ask the question since you were discussing the subject. I’m skeptical that PA actually followed the order. If not and SCOTUS says PA legislature controls then they have no way to segregate the votes to be thrown out and the only remedy is for legislature to pick electors. That’s my 2 cents.

...Sandra Smith, Banderas, Cavuto...They must have caught this because they all are condescending and rude to their guests.
