In other words 1) whether Judge Sullivan should disqualify himself for perceived partiality, and 2) if Sullivan should disqualify himself as a party to the proceeding.
At least some judges in the Court of Appeals are not satisfied with Judge Sullivan's stand.

The DOJ is executive branch. The courts are judicial branch. The judges do not take orders from the DoJ
Most important piece here:
“when requested by one or both parties to the case”.
The Judge is not a party to the case.

I’m sorry to say a lot of the comments here are ignorant of the legal system and rule of law. Are the judges biased? Probably. But presidents selected those judges that’s how it works.
We can’t pull judges off the bench every time it’s a judge we don’t like. There’s a system for that it’s called impeachment.
This is the Constitution you all love so much.
Does it suck in this case? Yeah. That’s why you need Trump reelected to appoint more judges.
