Boom. Attorney General William Barr made another move to clear the snakes out of his Justice Department yesterday, and the snake doesnt want to ssssssslither away.
On Friday afternoon, Barr released a statement announcing that Southern District of New York U.S. Attorney Geoffrey Berman, the weasel who led several of the cases dummied up by Robert Mueller, was stepping down, and nominated currently the Chairman of the Securities and Exchange Commission, to replace him:
Attorney General William P. Barr has released the following statement:
I am pleased to announce that President Trump intends to nominate Jay Clayton, currently the Chairman of the Securities and Exchange Commission, to serve as the next United States Attorney for the Southern District of New York. For the past three years, Jay has been an extraordinarily successful SEC Chairman, overseeing efforts to modernize regulation of the capital markets, protect Main Street investors, enhance American competitiveness, and address challenges ranging from cybersecurity issues to the COVID-19 pandemic. His management experience and expertise in financial regulation give him an ideal background to lead the United States Attorneys Office for the Southern District of New York, and he will be a worthy successor to the many historic figures who have held that post. On behalf of the President, I thank Jay for accepting this nomination, and I look forward to working with him soon.
On my recommendation, the President has appointed Craig Carpenito, currently the United States Attorney for the District of New Jersey, to serve as the Acting United States Attorney for the Southern District of New York, while the Senate is considering Jay Claytons nomination. This appointment will be effective July 3, and Craig will work closely with the outgoing United States Attorney to ensure a smooth transition. I thank Craig for his continued service and for taking on this important interim responsibility.
Finally, I thank Geoffrey Berman, who is stepping down after two-and-a-half years of service as United States Attorney for the Southern District of New York. With tenacity and savvy, Geoff has done an excellent job leading one of our nations most significant U.S. Attorneys Offices, achieving many successes on consequential civil and criminal matters. I appreciate his service to the Department of Justice and our nation, and I wish him well in the future.
A couple of hours later, Berman an ally of the radical Lawfare crowd that is working to destroy the country via the court system said he was refusing to step down, based on the fact that he was appointed by the judges of the SDNY U.S. district court:
So, now we see Lawfare using the courts to take away the power of the executive, a clear violation of the separation of powers that Barr and President Trump simply must not allow to stand.
The leftists in the Twitter perpetual outrage mob are all squealing that Barrs move here amounts to a Friday Night Massacre and a cover-up of an array of Trump crimes that exist in the fantasy bubble they all inhabit. Because of course they are.
Much more likely is that Barr is removing yet another corrupt Democrat plant serving as a Deep State roadblock to the investigation being conducted by John Durham. The jettisoning of Berman comes on the heels of the forced resignations of head FBI lawyer Dana Boente and Justice Department solicitor general Noel Francisco, both Obama-era embeds who could not be trusted by Durham and Barr. Bermans forced departure also comes after Barr has had several specially-appointed U.S. attorneys spending the last several months conducting a detailed review of his efforts on behalf of the Mueller team and its attempted coup detat on President Trump.
Berman obviously plans to fight his firing on behalf of this Lawfare allies. Barr should accommodate him by starting the fight with U.S. Marshals showing up at his office door Monday morning and escorting him from the premises.
That is all.
Welcomed swamp cleaning, but can Berman be fired?
On June 19, 2020, Attorney General William Barr announced that Berman would step down from his post on July 3, with New Jersey U.S. Attorney Craig Carpenito serving as interim while the Senate considered Jay Clayton, the chairman of the U.S. Securities and Exchange Commission, as his replacement. Hours later, Berman stated that he had not resigned, and did not intend to resign, until “a presidentially appointed nominee is confirmed by the Senate.” As Berman was appointed by the United States District Court for the Southern District of New York under 28 U.S.C. § 546(d) and is hence a judicially appointed acting official, it is unclear whether the Attorney General can remove Berman as U.S. Attorney without a Senate-confirmed successor. When Trump and Barr sought to oust Berman, he was reportedly investigating Rudy Giuliani, a Trump associate.
Take away his security key card, confiscate his computer and disallow him from returning to his office... He’ll get the message.
Using their Article III appointment powers. It's in the penumbra of the Constitution. Judges are to judge, and they judged that Trump could not appoint a "qualified" US attorney so they appointed one for him. /sarc
The most EVIL administration in the history of this glorious republic by far. DOJ cannot put a ham sandwich on any of their heads? All they have left is baloney. King Kong Bundy could’ve delivered better justice...
NO justice, NO republic, NO civilization. Witness daily...the destruction of the republic. Children wake up from nightmares. Parents are waking up to nightmares.
The DC Divide & Control SUPERCRIMINAL MONOPOLISTS gave themselves multiple “Get Out of Jail FREE” cards in addition to multiple monies, foreign and domestic. The Eminem gangsters, Mattis & Milley, back them up. It’s complex that MiC.
It reminds me of a preacher that got fired. The preacher upon hearing he was fired told the Elders they did not have the authority to fire him. One wise Elder stood up and said, well, we may not have the authority to fire you but you are not getting paid and you cant preach here.
“Lawfare” is FUBARR.
As the article says, send in U.S. Marshals to escort him out Monday
The method of appointment does not affect the right of a President to fire anyone whose position is one that serves at the pleasure of the President.
GET TOUGH, AG BARR!! DON’T LET THESE PUNKS KICK YOU AROUND!
Remember the controversy over who was to be the acting director of the Consumer Financial Protection Bureau (CFPB). [ English v. Trump ]
Alternative methods of filling vacancies can be legislated for various positions to take care of instances where the President chooses not to or neglects to involve himself in filling a vacancy. But once a President gets involved, it is all up to him, back up provisions are no longer relevant.
and Justice Department solicitor general Noel Francisco, ....
Noel messed up the slam dunk DACA litigation.
President Trump needs to find and eject all the DOJ weasels before Durham takes the stage
Barr should accommodate him by starting the fight with U.S. Marshals showing up at his office door Monday morning and escorting him from the premises.
Exactly right. Do it before it becomes a cause celebre.
Swift action prevents things from festering.
Yep, “disconnect” and isolate him. Can’t do much when all forms of access are taken away.
AssPress is all over this in my online morning rag (lead story), of course portraying it as the corrupt president illicitly attempting to remove a noble prosecutor attempting to root out corruption in the Trump administration.
And if it does, fire somebody else. Thats what Obama did. Conservatives barely had time to get worked up about one outrage before he was on to the next one. After a few weeks - or even days - the previous one was forgotten.
Just turn them off. Simple. No access at all.
