Judge Emmett Sullivan Hires High-Powered DC Attorney to Fight Flynn Mandamus Case in Appeals Court

D.C. federal Judge Emmett Sullivan has hired Beth Wilkinson, a high-powered attorney from the D.C. establishment, to represent him in the Court of Appeals case seeking a writ of mandamus filed by Sidney Powell, the attorney for former Trump National Security Advisor Lt. Gen Michael Flynn (Army Ret.). Powell is seeking to have the appeals court block Sullivan’s efforts to prolong the Flynn case in the face of a motion by the Justice Department to dismiss the with prejudice and to have Sullivan removed form the case. In a stunning move, Sullivan had previously announced the appointment of former federal judge John Gleeson to act as an amicus opposed to the DOJ’s dismissal of the Flynn case–in a sense appointing his own prosecutor to continue the case.

Flynn had pleaded guilty to lying to the FBI and was awaiting sentencing but has since changed attorneys and moved to withdraw his plea with the new hire Powell exposing government efforts to set-up and entrap Flynn, cover-up evidence exonerating Flynn and threaten Flynn’s son with malicious prosecution. The DOJ recently moved to dismiss the case with prejudice after the revelations of massive misconduct were exposed.

Sullivan is at least the second federal judge Wilkinson has represented. Last year Wilkinson defended Judge Brett Kavanaugh in his Senate confirmation hearings for his Supreme Court nomination where he was falsely accused by Christine Blasey Ford and others of sexual assault in his high school and college years.

The Washington Post reported Saturday on Sullivan’s latest move (excerpt):

The federal judge who refused a Justice Department request to immediately drop the prosecution of former Trump adviser Michael Flynn has hired a high-profile trial lawyer to argue his reasons for investigating whether dismissing the case is legally or ethically appropriate.

In a rare step that adds to this criminal case’s already unusual path, U.S. District Judge Emmet G. Sullivan has retained Beth Wilkinson to represent him in defending his decision to a federal appeals court in Washington, according to a person familiar with the hire who spoke on the condition of anonymity because of the sensitivity of the matter. The U.S. District Court of Appeals for the D.C. Circuit is now examining the judge’s actions and the larger case against Flynn after lawyers for Trump’s former national security adviser asked the court to force Sullivan to toss Flynn’s guilty plea.

Wilkinson, known for her top-notch legal skills and get-results style, is expected to file a notice with the court in the coming week about representing the judge. She declined to comment when reached Friday evening. Sullivan also declined to comment through his office.

Well, I suppose that’s one way to ensure you lose. Is this judge insane? He’s being asked to defend his legal position by a superior court and he cannot speak for himself and defend his rationale?

He’s just said all that I or they need to hear.

This judge is a loser beyond imagining.

Barr can do what he wants. He can get an attorney just as Sullivan has — get a whole law firm if he wants — and make his case that he has the right to fire Sullivan, regardless of what the eviro-whackos did or didn’t do in the 70s, or the how far things got pushed in the litigious 1980s & 1990s. Barr was from the 70s too and he can push just like the whackos pushed things. Why not? Two can play at mockery of the courts and not just the left. The upshot of it all would be, IMHO, that everybody would resign based on the best judgments and interests of everybody concerned, lawyers and judges, and that they go back to normal procedures... besides, normal procedures have a long precedent. If Barr was smart he could even use the argument of long precedent from the very beginning. I’m not a lawyer nor play the bagpipes.

Sullivan isn’t coming up with all these chaos maneuvers. He is being controlled and getting instructions from the same gang of lawyers and deep state actors that instructed and controlled Mueller.

This is really getting bizarre - the judge is not a defendant, why does he need an attorney to defend his actions against his own court of appeals? Is the appeals court even going to permit this kind of nonsense?

That link matches up with what I’ve been able to find out about his two sons. I found out Emmett Sullivan Sr. has been living in DC his whole life! Talk about a swamp rat!

Seems like somebody got a hold the judge & it must be pretty strong for sullivan to put his career on the line for this case.

In another thread, a freeper expressed the theory that this lawyer may have been hired for the express purpose of being a client/attorney protected communication channel between Sullivan and the deep state. (She is also representing several of Hillary’s associates) The theory seemed pretty plausible to me.

Basically, Judge Sullivan is stuck due to the appeals court order: he’s got to dismiss in the next 10 days or he has to produce a doozy of a legal argument for why he can flout Federal procedure rules and existing precedent in extending Flynn’s trial. So, he needs clarification from whomever he’s getting his marching orders from. Hence the connected lawyer. He knows he can’t telephone or email deep state operatives because Barr and friends are investigating and doesn’t want to chance those communications being intercepted. Granted, this is all theory and supposition, but it does tend to fit the facts as we know them so far.

One wonders why Sullivan is trying to drag this out? Could it be because of the gag orders Flynn is under will no longer be enforceable after the case is dropped? What does Flynn have to say that they don’t want us to hear?

Yeah you keep thinking that way. No wonder why the demonrats roughshod all over Americans. They never took Civics 101.

Your claim is that Barr can fire the Federally appointed Judge. No he can’t. Again learn your civics. To remove a Federal Judge takes an act of Impeachment by the House of Reps. So here is a little trivia for you, who is the only judge impeached by the House of Representatives and removed from office that got to vote on an impeachment of a sitting President.

So this is all based on your opinion, tear up the Constitution just to get rid of a rogue Judge? Barr and Trump can ask the courts to move on this and Trump can pardon Flynn. Which for intents and purposes is a trap for Trump to just that.

Trump is doing the right thing injecting conservatism into the Judicial branch but the Senate has really stopped confirming his picks during the pandemic. There are over 100 vacancies for Trump’s appointments.

You can’t mock the court if the court is against you. Getting a law firm to do what? The Judge has his marching orders. Barr doesn’t need to interject because he can’t interject. Flynn has a lawyer. Barr cannot go in and superimpose himself or his contingent of lawyers without the permission of the defendant. It’s like the Federal Government cannot intervene in a disaster until asked by the state. There is procedure, laws and policies. Whether you like them or not they need to be followed until they are changed. If you dislike the law so much, change it. You do that through another lengthy procedure leading to the amendment of the Constitution.

You don’t need to be a lawyer to know that the US Government is made up of three co-equal branches, Executive, Legislative and Judicial. That should have been learned since around the fourth grade. But oh wait we have Kommon Kore teaching our children.

Since this is an ap[p;ication for a Mandamus Order, the jusge is the sunject of the order but he is not a party to the cause in question.

This is about t he parties not Judge Sullivan.

I will be surprised if the Appeals Court accepts a filing of a Notce of Appearance by Wilkinson.

This is what is insidious, Sullivan means to make himself a party in a criminal case, whichi is the abandonment of his judicial duties.

It would not surprise me if the Appeals Court simply grants the Order of Mandamus now.

yeah, i don’t think that’s gonna happen; if anything, i would imagine the appeals court will look even more dimly on Sullivan’s antics ...

So why doesn't Flynn's lawyer Sidney Powell sue to obtain Judge Sullivan's attorney's work product?

The wall of lawyer-client privilege was breached in the case of PDJT's lawyer Michael Cohen, wasn't it? Why not here too?
