When did a republic extricate itself from imminent tyranny through the election of better or more virtuous people?
Perhaps Article V opponents will point to the election of President Trump. Theres no doubt that he is a reprieve, but a reprieve is just that, a temporary interruption, a finger in the dike to the tide of tyranny.1 Can we somehow do likewise with Congress and Scotus? Just elect better congressmen and senators who in turn will only consent to conservative judges? Is it reasonable to believe we can do with Congress in the future what we havent done since the 17th Amendment of 1913? Or are we to forget about an incorrigible Congress and wager our liberty on a Trump-like successor in 2024?
The corollary to electing better people is the Article V COS opponents sugary bumper-sticker slogan to Just Enforce the Constitution we Have. Here, they disregard the structure of government, as if the 17th Amendment doesnt matter, and any ol construction will suffice to secure liberty. On what historical or philosophical basis do they build these beliefs?
They are built on the belief that the 1787 Constitution is proof of a virtuous people. If they werent virtuous, it follows they wouldnt have bothered with our wonderful Constitution. Yet, if governmental structure is irrelevant, and the people back then were virtuous, why didnt the government of the Articles of Confederation achieve its stated purposes? Should the states have sent better delegates to the Confederation Congress? Had the people sent better men to their state legislatures perhaps the states would have obeyed the Articles of Confederation and complied with tax requisitions and obeyed the peace treaty with Great Britain. Its great to enjoy this time of Trump and I pray and believe he will win another term. Lots of conervative judges being put in place which is good. Still we know that evil never sleeps and never stops. This all too breif reprieve may give the Dems time to build a new breed. Imagine how many kids going through highschool now will be able to vote in 6 years. The future is millions of little AOCs. So is this a time to prepare and make ready in whatever way you see fit?
As I wrote, "lets accept for the sake of argument here that Article V Conventions, instead of Scotus decisions, actually did these horrid things to the Constitution from the mid-20th to early 21st centuries. If conventions proposed these disgraces as formal amendments to the Constitution, at least wed know they were Constitutional. As the product of Article V Conventions, they are all subject to possible correction by future Conventions. Not so today. Scotus amendments are beyond the electoral reach of the people. We are at best the subjects of Scotus, and at worst, its slaves."
Id rather live in a screwed-up republic screwed up by the sovereign people than be a slave to five lawyers in a phony republic in which the people are too timid and beaten down to take peaceful measures to save themselves and their posterity
I would very much appreciate some insight on the “Article V idea. All the talk seems to be that the power of the convention can or cannot be limited,etc. My question is this: how does a new piece of paper regardless of what is written on it or who wrote it, constrain the Left?
I understand our reverence for our founding documents, but we do not live in that world anymore, if we ever did.

I am not going to get snippy about blog pimping since I am a subscriber to the blog. I do sense the timing is important to avoiding the wrath of a certain blog pimping attack advocate.
I find the follow on squib written in 2016 to be far more relevant than your latest. http://articlevblog.com/2016/11/scotus-and-societal-corruption/I have been a follower of Article V efforts long before COS came along, or the now defunct Assembly of State Legislatures.
Your 2016 squib does not inspire me to sign on to the COS methods for all your stated reasons and the major point of disagreement placing too much blame on SCOTUS. I am not denying SCOTUS as an issue, just that We the People deserve our share of the blame, otherwise how over many many years did we suddenly find ourselves where we are.
We or our forefathers allowed what has happened to happen. It was never the fault of the Constitution, and so amending it or proposing amendments when the Constitution is not the problem would only exacerbate the situation.
We are the problem, and the SCOTUS enabled we through decisions the conservative populace were not in favor of. The progressive side of the populace growing ever larger, louder, and loving the progressive direction toward the Hell they see as Utopia have been bolstered to the point we are split down the middle in appearance.
The split however is not equal. the conservative populace still outnumbers the progressives but only when sufficiently motivated by maybe a Donald J. Trump. Before I get further in the weeds, we agree completely that repeal of the Seventeenth Amendment should be front and center as an issue of States Rights gone wrong.
I see that as a far better issue to bring us back to reality than endless amendments none of which will solve the problems brought about by the Seventeenth, and very well could open the Constitution to way too much needless progressive scrutiny.
Excellent point, to which COS might say, it takes 38 States to ratify and in today’s world the majority are conservative Republican so it would seem impossible that the impossible could happen. I would say, why propose amendments to a document that is not the problem, thereby risking other problems.
What comes to mind is the recent Circus surrounding the Kavenaugh hearings. Maybe those desiring a fluid and changeable Constitution are more interested in a forum where the Constitution is brought under scrutiny rather than as COS would have us believe a safe forum to propose amendments where nothing bad could possibly happen.

All of those things would help, but we need to lock in measures to prevent abusive people from abusing the levers of government. Congress will not do it.

So... use the COS to propose repeal of the 17th. Congress certainly never will. It was one of the keys to the tyranny of our present government.

We’re making progress in the states. Slow but sure. Had The Beast won in 2016 we might be looking at a COS this year.
That simple fact is beyond the intellectual reach of the Jaywalkers.
