Yes, they should be prosecuted for treason. Today’s headlines might allow the enemy access to sensitive information which could lead to the death of agents, the planning of murderous attacks, etc. It’s about time the news outlets showed a little gratitude to the country which allowed them to exist and prosper by keeping their secrets, even if the providers of same could not.
But how do they know it’s classified? I guess if they get a copy of the document with the TOP SECRET stamp on it, OK.
But if it’s just an email, how would they know?
That depends on whether we trust our own government, politicians, bureaucrats, spooks.
Does anybody here trust them? After the revelations of the last elections showing what an incredible corrupt swamp washington is, don’t we need more not less whistle blowers?
Releasing secrets that truly harm the country, should be punished. Releasing secrets that show the corruption and lies of politicians and bureaucrats should be rewarded, regardless of party.
I thought that this was settled by the SCOTUS in the Pentagon Papers case. As I remember, The Washington Post could print but the leaker was in trouble. Do I remember it right?
The Government classifies a lot of stuff that should never be classified to keep it away from us citizens because they know it would damage them and the many unconstitutional things they do.
There is a lot of real classified stuff that we have no need to know about and should probably never see the light of day but too much is stamped classified just to keep it from us.

The guilty party is the leaker, who was legally bound to secure the information.
Subsequent propagators and consumers of the information are blameless.

If someone knowingly publishes classified information, they are intentionally doing something that could harm the Country. in that case I believe that person should be subject to prosecution.

You’re correct:
No law exists for those not having clearances. The uncleared have no way to discern if a document is classified - and markings are not enough. If a law was created, welcome to a worse tyranny than we already have here.
However, if leaked to the public, a document’s classification status doesn’t change.
