Youve been snookered folks! By that poor elderly doctor who was involuntarily dragged from his seat, had his face smashed in, and was beaten unconscious by the evil airport security at the behest of United Airlines.
Because theres no evidence any of that was true. It was in fact a premeditated temper tantrum gone viral, comprising one 69-year-old Vietnamese-American David Dao, a medical doctor who lost his license, planning a lawsuit from the moment United first politely asked him to give up his seat. He demanded to be dragged, did an excellent impersonation of Ned Beattys character in that horrific scene in Deliverance, and struck his lip on an armrest. From the many videos taken by numerous passengers, obviously from numerous angles, theres no evidence of a beating, a serious concussion, or bodily damage beyond that lip.
That's your cross to bear.
I am not a lawyer so this is a question. Isn’t there a principle in contract law that states that any ambiguity in a contract benefits the party who did NOT draft it? And if that is the case would it not benefit the Dr. here?
The simplest solution in the world is staring you right in the face. United just needs to tweak their ToS, so passengers understand the rules.
Namely, if United wants the option of kicking well-behaved, legally-boarded passengers off the plane, so as to give their seats to otherss, simply spell that out in their ToS. It’s just a matter of
telling their passengers in advance that being boarded and seated, etc., is no guarantee of remaining on the plane. If United decides they want your seat for someone else, youre SOL. Your only choice is whether to meekly comply, or to be dragged out bleeding and brain injured.
If United spells that out in their ToS, in plain, intelligible language, all disputes end. And since you claim that’s their policy anyway, they have nothing to lose. Honesty is always the best policy.

The party in question claims to have been on this site for ages, and now is “back.” Since the poster states he/she is a retread, we should take him/her at their word.
Of course there’s no chance the party will reveal their former ID. Wouldn’t want us to see why they were banned, you know.
And WHEN did somebody realize that they would need to transport this crew? And when SHOULD somebody have realized that a new crew would be needed?
If somebody had alerted the boarding agents BEFORE boarding, then the issue would not have occurred.

Rule 25 says you are entitled to CASH (technically, not CASH, but a CHECK). Relevant section reproduced here. A passenger is not obliged to settle for a stinkin' voucher.
A.5. Payment Time and Form for Passengers Traveling Between Points within the United States or from the United States to a Foreign PointContract of Carriage Document | United Airlines1. Compensation in the form of check will be made by UA on the day and at the place where the failure to provide confirmed reserved space occurs, and if accepted by the Passenger, the Passenger will provide a signed receipt to UA. However, when UA has arranged, for the Passenger's convenience, Alternate Transportation that departs before the compensation to the Passenger under this provision can be prepared and given to the Passenger, the compensation shall be sent by mail or other means to the Passenger within 24 hours thereafter.
2. UA may offer free or reduced rate air transportation in lieu of a check payment due under this Rule, if the value of the transportation credit offered is equal to or greater than the monetary compensation otherwise due and UA informs the Passenger of the amount and that the Passenger may decline the transportation benefit and receive the monetary compensation.

CoC says UAL can deny boarding. He was boarded. They violently unboarded him. Thing is, they've gotten away with breaking their own contract for so long that people who should know better don't.
UAL says he was boarded. When read out against the CoC, this statement is soooo going to come back to haunt them.
On Sunday, April 9, after United Express Flight 3411 was fully boarded, Uniteds gate agents were approached by crewmembers that were told they needed to board the flight.
I hope so.
