Texas Sen. Ted Cruz has won a case in Pennsylvanias highest court that had challenged his eligibility to appear on the states GOP primary ballot and serve as president.
The state Supreme Court order Thursday upheld a lower-court judges decision to dismiss the case.
A Pittsburgh resident and registered Republican voter, Carmon Elliott, had argued that Cruz isnt eligible to run for president or to appear on Pennsylvanias April 26 primary ballot because he was born in Canada.

I would prefer to see what a Federal Court would rule. That is where the ultimate
ruling will have to come from.
Nope. But I imagine the more lower courts throw this silly case out the less likely the SCOTUS will ever agree to hear it.
Of course theres always hope Obama gets to seat his pick.
Your remark: They did not rule him eligible just refused to hear it.
This is not correct, read the decision of the original judge:

The Pennsylvania Supreme Court affirmed the decision which makes Cruz eligible in Pennsylvania, period. This is the first time any court has directly decided a Presidential eligibility case.
I recommend that you avoid paying attention to the Birther crowd.
i’m glad trump said it was a mistake to attack Heidi.
it’s the SMART move. he went too far saying current abortion law is good, but he is being told and trained by someone, probably Ivanka, lol, to swallow pride.
admitting mistakes (even if we don’t agree the abortion statement was one) goes a FAR way with voters.
I am hopeful that he can change some character issues that need changing if he is to go all the way.
Elliott is appealing to the US Supreme Court
And we have so many Constitutional Law experts, don’t we?
We will soon be deluged with the standard: Minor v. Heppersett and Wong Kim Ark, those are always impressive.
The Pennsylvania S.C. denied the appeal without comment.
The lower court ruling was based on law review articles.
They all know he’s not eligible. He asked for a resolution from Mitch McConnell similar to what they drafted for McCain and was rejected.
Over the last 20 years Congress has unsuccessfully sought 11 times to amend the NBC requirement. Each time they have failed. If it didn’t matter where potus was born, there would have been no reason for BHO to struggle with doctoring a Hawaiian BC. No one would have cared where he was born. Nor McCain, Panama would have been just fine.
These people want to open the door for our enemies to rule us and further erode our sovereignty.
Give it up Trumpbots.
You’re correct, which means that the Pelligrini decision stands. Per Curiam (the actual words of the order) is usually (but, not always) chosen for noncontroversial issues that are unanimously decided. We can’t know for sure, but it’s a good guess that they thought it would be a waste of time to write an opinion.
If you want to hang your hat on that, good luck to you.
After that I'd like to see less re-statement of what wrong with the system and some more detailed and better articulated policy solutions.
Dual loyalties at birth. Ted Cruz is not a natural born citizen.
The effort to finally kill the natural born clause is in full swing.... Obama followed by Cruz and there will be no turning back.
We would all do well to keep the greatest protection to the highest office in the land.
> Give it up Trumpbots.
Eligibility is of concern to only Trump supporters?
Amazing.
How can someone with dual citizenship not have divided loyalties? We all know he only just renounced it but nobody addresses this obvious conflict.
Will you at least grant that the more often courts throw the case out, the less cause there is for concern?
Keep in mind Trump said he thought Cruz was eligible until Cruz began nipping at his heels. Trump uses the Same play book as Obozo.
What does that have to do with alleging only “Trumpbots” are concerned with eligibility?
Frankly, I noticed that correlation too.
