Texas Sen. Ted Cruz has won a case in Pennsylvania’s highest court that had challenged his eligibility to appear on the state’s GOP primary ballot and serve as president.

The state Supreme Court order Thursday upheld a lower-court judge’s decision to dismiss the case.

A Pittsburgh resident and registered Republican voter, Carmon Elliott, had argued that Cruz isn’t eligible to run for president or to appear on Pennsylvania’s April 26 primary ballot because he was born in Canada.

So the Courts have taken the cowardly path by refusing to consider it

The whole Canadian birth matter is foolish, but fools don’t care.

Cruz 2016.

They did not rule him eligible just refused to hear it. So this will drag on in other courts when it needs to be settled not just about Cruz. But what is NBC. A ISIS son born to an American mother but raised terrorist could someday be deemed eligible to run for president without clear definition that all understand.

Actually it's quite liberating.

Especially for the criminal class.

Sir, I am not a fool. I can read the Constitution. Judges are not supreme rulers...for example Justice Roberts and Obamacare..

Obama all over again.

If Cruz ends up the nominee, Trump should sue. He would have standing and would have been harmed. But that’s not going to happen, Cruz winning that is.....

GO TRUMP!

I trust you all know that state courts don’t answer this HUGE federal legal question. It will get answered by Hillary. What do you bet the answer will be?

Not only that, wasn’t the original case brought by a Rubio supporter some time ago?

I guess an America visiting to do inspections in North Korea who has sex with one of the ladies there who gets pregnant can be our president in 35 years. Such a mockery of our founders Cruz is doing.

This issue is fundamentally a federal question regarding Cruz’s constitutional NBC eligibility and needs to be decided in a federal court. He seems utterly disinclined to try to have this matter decided in a federal court and has blocked others’ attempts to do so. This to me demonstrates bad faith on Cruz’s part as he is willing to gamble with the election and being possibly DQ’d as the nominee thus jeopardizing the election to the socialists by default.

For me, this demonstrates Cruz’s concern for his own political prospects over America’s best interests.

A state court said Cruz eligible because a law review article said so. Not even worth citing as authority in the next case on it. Somewhere someday a judge is going to to have to sack up and settle this. Taking Cruz’ reasoning on the matter renders the term meaningless, NBC, I mean. The founders didn’t waste words so that’s an unsatisfactory reading.

And not considering it is not the same as winning the ruling. This could come back as an issue in the general.

So far, the only people bringing birther lawsuits against Ted Cruz are Donald Trump surrogates in one guise or the other.

No! It didn't happen again?

The Constitutional experts here have assured me Cruz is ineligible.
